Supreme Court ruling on travel ban (another compromise ruling)

The Government’s motion seeking clarification of our order of June 26, 2017, is denied. The District Court order modifying the preliminary injunction with respect to refugees covered by a formal assurance is stayed pending resolution of the Government’s appeal to the Court of Appeals for the Ninth Circuit. Justice Thomas, Justice Alito, and Justice Gorsuch would have stayed the District Court order in its entirety.

The ruling allows grandparents and other relatives in, because the court refused to overturn the Hawaii Judge's definition of "close family".

However, another part of the Hawaii Judge's ruling was stayed.

The president has the power to act on this without the court. But the media would lynch him and start screaming, “impeach!”.

But the courts have grown way, way too big...

stay means pause or stop going forward. Lower court definition was stayed and that should be considered a win.

Okay, I ain’t the sharpest knife in the drawer but even I can understand the statute. Basically it allows the president to block anybody from anywhere for any damn reason whenever “HE” deems it in the best interest of the United States of America. How freakin’ hard is that? Sheesh.

Not how I read the ruling. The Supreme Court has temporarily stayed the (Hawaii) District Court's modification of "close family" until the government's appeal to the 9th circus regarding the modification has been heard and ruled on.

Justices Thomas, Alito, and Gorsuch concurred with the temporary stay of the (Hawaii) district court's modification of the definition of 'close family,' but would have made the stay permanent, mooting any appeal to the 9th circus.

Sessions needs to dig deep and get the details of Odunga's spying on John Roberts in order to 'turn him' especially on his Obamacare decision. Something OBVIOUSLY devious happened there, given Robert's initial standing AGAINST Obamacare.

Yes. The added language about the pending hearing does not prevent the Administration from going forward. It merely reiterates the fact that the matter will be heard on the merits, this fall.

The three Conservatives simply wanted a more blunt statement; but it would have been to the same practical effect.

Only the part of the ruling unrelated to the definition of “close family” was stayed. The Hawaii Judge’s expansion of the definition to include grandparents, grandchildren, aunts, uncles, nieces, nephews, cousins, brothers-in-law and sisters-in-law remains in effect (meaning these additional relatives must be let in immediately from all countries).

The good news is Gorsuch so far is ruling as Scalia would have. The bad news is Kennedy is staying on long enough to inflict more damage. Roberts is worse then Kennedy and a total loss whether blackmailed or just a Trojan Horse l don’t know either way he’s another Warren and a disaster.

No, the first sentence of the order (dismissing the Federal government request to “clarify”) was regarding the “close family” definition which the State Dept defined and then the Hawaii Judge overturned.

Why does the President suck up to the Courts at all? Because Congress is too cowardly to rein them in. The Courts are now above the Executive and Legislative branches. And they like it because they can blame the courts for their own incompetence.

The actual order, which you posted at the beginning stays the modification by the District Court, pending further proceeding. It does allow a potential action by the Ninth Circuit, which would eventually have to come back to the Supreme Court, with the rest of the case; but for now, there should be no problem. (In other words the White House has not lost on the additional relatives issue; although the Ninth Circuit could in effect, put it back on the front burner—as it were.

You are correct, and I was wrong. The Supreme Court stayed the part of Hawaii’s ruling that allowed those with a ‘contractural relationship’ (such as churches willing to take in refugees) but left in place the modification to the government’s definition of ‘close relationship.’

Mea culpa.
