The Supreme Court enters its final week of work before a long summer hiatus with action expected on the Trump administration's travel ban and a decision due in a separation of church and state case that arises from a Missouri church playground.
The biggest news of all, though, would be if Justice Anthony Kennedy were to use the court's last public session on Monday to announce his retirement.
To be sure, Kennedy has given no public sign that he will retire this year and give President Donald Trump his second high court pick in the first months of his administration. Kennedy's departure would allow conservatives to take firm control of the court.

That's the first possible real evidence I've seen to suggest Kennedy might retire. Maybe someone, somewhere knows more, but it still seems to be mostly speculation. But it would be good for President Trump to appoint a Kennedy successor this summer.
Although nominated by Reagan, Kennedy got all caught up in the ‘swing vote’ aspect of his term. With four conservative votes and four liberal votes on each case before the Supreme Court, his deciding vote made him, in effect, the most powerful man in America.
Pray for the repubs to grow spines in the meantime. There are continuous battles ahead with the LIBs.

I always said that if Trump did nothing but keep his promises about the supreme court, that alone would make him a million percent better than Hillary. Of course, Trump has kept many of his other promises, and others would be kept if Paul Ryan’s Uniparty branch of Congress wasn’t bought and paid for by the oligarchs.
If Kennedy retires, I predict that Trump will get two more at least, but he will probably accidentally screw one up, misjudge one of his choices. Pubbies have a dismal record of Scotus appointments.

The perfect scenario would be for Breyer, Kennedy and Ginsberg to all be replaced by conservatives, as well as Clarence Thomas who has hinted at retirement. That would give 6 solid conservative votes and 1 sometimes conservative vote in Roberts (although I suspect he would lurch completely left the moment that Kennedy was gone). That would leave Alito as the oldest conservative on the bench and he’s only 67 - still many years left if his health holds up.
If Kennedy gets replaced by a Constitutionalist, it makes Roberts the new "swing vote". It would take one more replacement of a Leftist to bring the Court firmly to the right.
What a dream! But could happen! I definitely want to see at least one Leftist replaced before they get to work unwinding the last 85 years of Progressivism. Once they start on that, it will be politically tough for the Republicans to keep winning...so I’d like them to keep their powder dry for now on the landmark rulings from the past - even if Kennedy is gone. We need to be sure to win those, and we need a court that will be strong enough to keep the Dems in power - which will likely happen if the Court really turns our direction.
