Sen. Patrick Leahy won’t join Gorsuch filibuster

The Senate’s most senior Democrat says he probably won’t join his party’s effort to filibuster Judge Neil Gorsuch, in the first major indication that Republicans may not have to resort to the so-called “nuclear option” to fill the empty Supreme Court seat.

Senator Patrick Leahy, Vermont Democrat, said he’ll vote against Judge Gorsuch’s nomination, but doesn’t think a filibuster is the right path.

“I am not inclined to filibuster, even though I’m not inclined to vote for him,” Leahy told the Vermont Digger on Sunday.

Well, at least one dumb ass democrat is wary of the nukes.

And personally, I think that even as weak as Yertle the Tertle is, he may invoke the nuke.

I think Trump is leaning on him for it.

We shall see.

He’s too lazy to participate in an actual filibuster. He’s not young any more.

This most likely is a crafty political move, intended to provide cover, defend against charges of intransigence, and to dissuade the use of the nuclear option.

The difference is between:

1. Gorsuch gets confirmed, the filibuster gets 'nuked,' and is thus unavailable to Senate Democrats should Trump get another Supreme Court pick.

2. Gorsuch gets confirmed, the filibuster remains intact as procedural leverage for Senate Democrats should Trump get another Supreme Court pick.

Those are really Schumer's only two choices right now. Even the usual Senate GOP suspects (McCain, Graham, Collins, Murkowski) are saying a filibuster of Gorsuch is unacceptable. No matter how much Schumer postures, he simply does not have the votes to do much more than wail.

I kind of wish the threshold for blocking filibusters was raised to 67 votes, and simultaneously the requirement of a filibuster to be conducted in person be enacted. It would probably help encourage some more senior senators to retire.
