Police: Victim shoots, critically wounds carjacker (ABQ NM)

ALBUQUERQUE, N.M. — A suspect who police say tried to carjack a man with two accomplices Monday night was in the hospital in critical but stable condition Tuesday after the driver of the car shot him.

The driver acted in self defense and is not facing charges, according to Albuquerque police spokesman Fred Duran.

Officers were called to the shooting, which was outside an apartment complex on the 3900 block of Montgomery NE near Montgomery and Carlisle, around 6:30 p.m.

They learned that three men had tried to to carjack a couple in a parking lot.

“The driver fired his weapon at the carjackers and struck one of them, causing the male serious injury,” police spokesman Fred Duran said.

“He will be charged accordingly from the results of the investigation after he gets released from the hospital,” he said.

The other two suspects fled and have not been caught or identified, Duran said.

Gotta love it when a citizen uses his Second Amendment constitutional right to thwart a car-jacking that could have gone very bad.

(BTW, in NM no permit is needed for open carry, concealed carry of an unloaded firearm, or transport of a loaded firearm either concealed or openly in a vehicle.)

Good. Endanger someone’s life or property, the victim has the right to self-defense, even if that means killing the unjust aggressor.

A criminal has to be stoooopid to attempt carjacking in that state.
Very risky and just for a dumb car.
They could "go in shooting" yet why get a murder charge for car theft?

Dave, you are flying the NM flag so let me ask.

This shooter in self defense was not charged with a crime. In the absence of criminal behavior, is it nonetheless NM's practice to confiscate the shooter's weapon "pending investigation"?

I don't know the answer to that. I'll pass the question on to a NM Freeper who has lots more gun/hobby shooting experience than me.

I am not aware of a case where a good self defense shoot resulted in the confiscation or retention of the shooter’s firearm unless there were circumstances under which it was regarded as evidence or some sort. We’re pretty gun friendly here.
