Wisconsin Recount Manual



Introduction

Elections are often decided by a few votes. In many cases they are decided by one or two votes out of the several hundred or even several thousand votes that are cast. An election may even end in a tie vote. These circumstances encourage a candidate, typically the one who loses the election, to have all the ballots counted again to assure all legal votes are counted properly, any illegal votes are not counted, and the proper procedures for conducting the election were followed by the election officials.

The process of counting the ballots again is known as a recount. There is no automatic recount. The procedures for requesting and conducting a recount are spelled out in the election laws. A recount is the exclusive remedy to test in court the right of a candidate to hold office based on the number of votes cast at an election.

This manual explains the statutory requirements for requesting a recount, attempts to explain ambiguity in those statutes, expands on the statutory requirements with recommended procedures for conducting a recount, and contains sample forms for use during the recount.

Stein lacks a factual basis for her belief that a mistake, fraud, defect, irregularity, or illegality HAS occurred. Neither Stein nor Halderman have provided any evidence to that effect.

Stein wants a recount in order to determine if there is any irregularity. This is exactly backwards.

Wisconsin law [Wis. Stat. § 9.01(1)(a)2.b] requires that a petitioner for a recount be informed and believe that a mistake, fraud, defect, irregularity, or illegality HAS occurred. Stein has provided no facts to inform her belief that any of this HAS occurred in Wisconsin. Indeed, her petition states that a recount is necessary to determine whether evidence of an irregularity exists.

Stein’s petition:

2. The Petitioner is informed and believes that an irregularity has occurred...

3. The Petitioner is informed and believes that:

g. “A hand count of paper ballots [] are necessary to make this determination”

Stein has not provided any evidence to support her belief that any irregularity has occurred and is requesting a recount to determine whether evidence supporting her belief exists.

try more like 60-70million or more. there was a youtube that gave a really good very detailed and well put together explanation of the problem over the decades. Even the amnesty in 80’s wasn’t just 3 million amnesty because there were millions more here at the time but unaccounted for.

Then demand any illegal alien votes be deleted. Supposedly over 3 million, with 2 million in CA alone.

California uses the "honor system" to vet their voters, very little else: same day registration, no voter ID requirements, etc.

I’ve only seen that deadline is passed when i look at PA website.

I've always thought the MSM lowballed the number. I remember 30 million being reported about ten years ago. It may be approaching 60-70 million as you said. And 'only' 3 million voted? Hope Trump's team gets to the bottom of this and reverses their votes somehow. We have to right the ship of state. SO many areas to work on. He really has a job ahead of him. .

The California system is a joke. So you can 'honor system' your way to voting 30 times? We need Voter ID with Driver's license, maybe birth certificate and only vote once. How difficult is that? At least we have two years before the mid-terms to work on this.

We need to daily Pray for Trump and his associates. We finally have someone who will Fight!

Agreed. Would be nice to see to see Soros arrested by Trumps DOJ then shipped off to Russia via extradition treaty to face certain justice there. He is wanted there for numerous crimes committed there. We will never hear from him again once the Russians have him!

Really the overall sense I get from this is an overwhelming amount of fear on the left. Not a viable course of action, but desperation.

So that leaves MI and WI with their 10+16 electoral votes.

President Elect Trump is at 306; take away 26 leaves 280, still enough to win.

What are the chances of a court win in PA?

I registered to vote in WA state, and no one asked to see my US Citizenship by Naturalization certificate. It was and is strictly an honor system. Before that I registered in Illinois, and IIRC it was a democrat precinct captain who came to my home and registered me. Again, did not ask to see proof of citizenship.

THere are several articles including Fox, Heavyy, etc that says Monday the 28th is the deadline for PA and Wednesday is the deadline for Michigan.

What is being done is not an attempt to change the result, this is an attempt to make the entire process seem unreliable and “illegitimate.” Was discussed here.

I think the most logical concern is that the Electoral Voters from Wisconsin aren’t allowed to participate on December 19. I think that is the Democrats end game.
In the Gore vs Bush debacle, Supremes ruled that a recount could not delay participation of the states electors, if I remember correctly. They also ruled 7-2 that the recount procedures were flawed since they did not apply the same to all the states votes -- only select few counties. The slim majority of 5-4 was on the opinion of whether FL could get it done correctly in time or not for the entire state. The majority 6 stating that they could not provide the remedy in time. So, the count stood because the Supreme Court stated that the states electors had to vote in Dec for the winner of the state's electors.
