2 Child Protective Services' Employees Placed on Administrative Leave Pending Investigation into 2-Month Old's Kidnapping

The baby boy is currently being held in a foster home in Mazatlán, Mexico

Two Child Protective Services' (CPS) employees were placed on administrative leave after a 2-month old baby was kidnapped by his mother and taken to Mexico, a spokesperson with San Diego County confirmed with NBC 7.

Baby Maximus Garcia was taken by his 36-year old mother Erika Ramos Saucedo last Thursday. The 2-month old had been dropped off at the South Bay Womens Recovery Center in National City by a CPS employee for a supervised visit.

But the baby was left alone with Saucedo, according to the National City Police Department (NCPD).

In that span of time, Saucedo took Maximus and fled to Mexico via the San Ysidro Port of Entry.

According to police, CPS reported the kidnapping to the NCPD at 11:53 a.m. Tuesday, more than two hours after Maximus was taken.

After a three-day search, the baby's father, received a tip from Facebook from one of Saucedo's ex-boyfriends, which led authorities to both the mother and son.

Documents from Child Protective Services regarding Ramos also show the agency was worried that Saucedo would flee with her child based on past behavior. She also has a long list of domestic violence cases against her.

NBC 7 spoke with the boy's biological father, Jose Garcia, on Tuesday. He told us he has seen Maximus but its unclear, at this point, whom the baby will be released to.

The baby boy is currently being held in a foster home in Mazatlán, Mexico.

In an interview last week, Garcia said he was angry that the employee left his son alone with Saucedo when it was supposed to be a supervised visit.

The county is now "investigating the incident" to find out exactly how the baby was kidnapped.

Not surprising. My husband’s ex-shrew is a CPS worker, now supervisor. Worst.parent.ever.

CPS only exists as a payback tool against biodad for daring to move on after a divorce.

How did she lose custody in the first place, so a "supervised visit" was necessary?

The child has a mother and a father, why was he in CPS custody?

In NYS, a mother that literally comes in dripping from an ax murder still gets custody.

It would have to be EXTREMELY bad to lose custody for a mother.

We have recently had several cases of mothers just standing by while their boyfriends kill their very own children from a previous relationship.

CPS was again sleeping at the switch.

Not necessarily. (I have no idea of the facts in this particular case.)

I’ve seen cases where excellent parents have lost custody and terrible parents have gotten custody. I think the whole CPS and judicial system is a racket. I’m pretty sure the judges and CPS workers can easily be bought if the price is right.

It’s a racket because during the Clinton years, Title IV was passed of the Social Security Act which basically funnels cash from the feds to local Child Support Collection Agencies for the most ‘child’ support dollars collected.

How does this translate into custody? Almost 90% of the time the mother gets custody. Which means that the father has to pay ‘child’ support to the mother (wealth redistribution instead of 50/50 custody with no CS changing hands)

This is the preferred set up in “family” court so that the most money can flow into local coffers. This is why it’s very hard for the father to get custody.

So many times I hear of a father mortgaging his house and spending tens of thousands of dollars in legal fees to get custody away from a druggy mom. No CS is usually ordered from non-custodial MOTHERS no matter how high their earnings are.

maybe 30 yrs ago custody was given to the mom more often, but I doubt that’s true now...my friend spent $25,000 to get even joint custody from her ex...her ex who was not even a natural citizen, who drank too much, and ran over the child’s foot while on his riding lawnmower completely cutting off the heel of her one foot....but even THAT did not sway the stinking court “commissioner”.

That is interesting. The cases I know where the father got custody, the mother was a high earner and they socked it to her.

Statistics in some states show that if the kids are over 5 years old and the father sues for custody, he wins in the majority of cases (Virginia? 90%? I don’t remember the exact figures), so there is corruption in both directions.

At any rate, “the best interests of the child” are the least of the courts concern.

Also it reminds me of the cases in Pennsylvania where a judge was sending kids to juvie on very minor offenses. Turned out he was getting a kickback from the company that profited from running the juvenile detention centers.

Maybe in a red state, but in the blue states, mothers have SPECIAL rights.

1. not held to same standard as a non custodial father
2. allowed to ream the system and live off of CS
3. get custody approaching 90% of the time due to Title IV of the Social Security Act.
