You may have heard of civil asset forfeiture.
That's where police can seize your property and cash without first proving you committed a crime; without a warrant and without arresting you, as long as they suspect that your property is somehow tied to a crime.
Now, the Oklahoma Highway Patrol has a device that also allows them to seize money in your bank account or on prepaid cards.
It's called an ERAD, or Electronic Recovery and Access to Data machine, and state police began using 16 of them last month.
Here's how it works. If a trooper suspects you may have money tied to some type of crime, the highway patrol can scan any cards you have and seize the money.
"We're gonna look for different factors in the way that you're acting, Oklahoma Highway Patrol Lt. John Vincent said. We're gonna look for if there's a difference in your story. If there's someway that we can prove that you're falsifying information to us about your business."
“the phone number”
Was in the industry for a while, phone numbers and area codes, don’t mean what they used to, even land lines. The phone number is basically an account number that identifies the owner to the telephone system, once that number is entered, and the call goes into the computerized phone system, it gets routed to anywhere in the world that the owner pays to send it.
My bank has the same local number, nearly identical to my own, as it had, when I moved to town, in 1990, but if I call it at three in the morning, it is answered in India, or the Phillipines.
Which state are you talking about? As described in the article, the People's Republic of Oklahoma, which has no respect for private property, certainly does not fit that description.
If there is a way to expel them, it shouldn't take long (what with them being surrounded and thus easily isolated) for them to come crawling back, re-ratify and actually start obeying the Constitution, and hand over the worst jack-booted thug offenders for prosecution.
” The law is clear. Without the due process of the law, you cannot be deprived of life, liberty, and property.”
You act as if “naive” is a virtue.
I have a friend Avi, who used to deal in the buying and selling of classic and exotic cars. That business is CASH ONLY. A cop pulled him over for speeding and next thing you know, he was relieved of $96,000 in cash. He could easily prove where the money came from, they didn’t give a $hit! After he hired a lawyer, the cops offered to settle for 1/2 the money. If he did wrong, why let go of half the money ? DUH !! He went to the press, and it scared the crooked cops into releasing all the money. I have other similar stories, but I picked the most egregious one to make the point.
He really probably doesn't belong on this forum.
You are hideously evil and you have utterly no place on a forum who’s goals are to protect freedom.
You are on the side of pure evil. Seizure of innocent people’s property. You belong in the old STASI, or perhaps you can get a gig in North Korea.
You are a miserable piece of s*** that deserves every single evil thing that will come at you in your life.
You must be from the Politburo.
I agree. Sagar is indeed a Richard Head.
Understand, many people voted for Hitler (for a lower political position then he eventually attained). Stalin was selected by many of his peers who were then killed by him.
Tyranny and Statism often have fans. Sagar is one.
Great examples, Laz.
If we dug in, I bet you a dollar he’s a big Establishment GOP guy.
I wouldn’t bet against it.
This is the worst. Presumption of guilt and very little (and delayed) recourse. Some of these businesses are out 6 figures and more and worse, their lives are being destroyed in fighting this.
How does this differ from a general warrant?
Agree on both counts:
>> Catching card skimmers is a worthy endeavor.<<
I just had my card skimmed (or random number generated) and replicated on a card fresh from the card writer. A bunch of parking lot, snack machine, and gas station charges later, the miscreants attempted two charges at a big Nike store for close to $900. Both charges denied of course. The card company was proactive and awesome about it. The rep and I chatted about it for a while, and she said that these guys buy card writers online for $100 or so and off they go.
>>However, civil forfeiture should be strictly illegal. <<
Yes, especially if filing criminal charges are not a prerequisite. I thought we got rid of the general warrant in 1791.
Republicans and so-called “law and justice” conservatives are just as much to blame for the unconstitutional RICO law and the equally unconstitutional asset forfeiture laws that flow from it.
Sidebar comment: I am a cop and I agree with you that asset forfeiture is out of control. Michigan just passed a asset forfeiture reform law. It’s a good start, but only a start.

I like you.
Thank you. I think highly of you as well.
