Is there any way Obama can fill Supreme Court vacancy?

Probably not. So he needs to decide how he wants to pressure Republicans. He has several options.

President Obama has promised to uphold his "constitutional responsibility" to nominate a replacement for Supreme Court Justice Antonin Scalia, a conservative stalwart who died over the weekend. Now, he just needs to decide whether to try to soften Republican senators with the pick or make it a full-throated, election-year political statement.

Numerous Senate Republicans have already said they will not confirm a new Supreme Court justice before this fall's presidential elections. Given that the new appointment could tilt the court's balance of power from conservative to liberal for the first time in decades, there is little reason to think Republicans are bluffing.

"I don't see the Republicans just giving in and giving President Obama the opportunity to do that," says Mark Hurwitz, a political scientist at Western Michigan University in Kalamazoo....

If we lose the Senate, then Obama will have a chance. Correct me if I am wrong, but the new Senate is sworn in Jan 3, but the new Pres isn’t sworn in until Jan 20th. So..... if the Dems get 51 senators in 2016, then there will be 17 days when O will have a Dem Senate while he is Pres. Watch the 60 vote rule evaporate for this “emergency”, only to re-appear when a Rep is in the WH.

If the Obungler nominates someone, I would say the odds are pretty good the pubbies will cave. They have priors.

Perfectly obvious (to me) that BO will nominate someone who will be a source of constant accusations against opponents, someone who can create the greatest division in America but will be phony enough to claim a totally false “moderate” image.

No worries - - Trump will correctly analyze the situation, describe it perfectly in a couple phrases, and use it to our advantage.

The problem is that the GOP has 24 of the 36 Senate seats up for election in in 2016. The Dims only need to win 4 for a tie and 5 to take control of the Senate. Something like 8 of those seats are up in states that went for Obama both times.

The talk of blocking any Obama nominee is purely BS aimed at the base in the primaries and will be quickly forgotten once a nominee is in place. What I see playing out is come September the GOP will find that they are in real danger of losing their majority in the Senate because the Dims and the media have once again successfully depicted them as obstructionists placing party over country. In response the Senate concerned about keeping their jobs and holding on to the majority will approve Obama’s nominee....

When push comes to shove the GOP will find retaining their majority is far more important than the justice that replaces Scalia. It’s imperative that they hold the Senate to fight another day. As Scalia proves these 80 year old justices are not going to last forever and it the GOP wants to stop the left from packing the Court with liberals for decades to come they must retain control of the Senate to have any shot of stopping the left’s takeover of the Court in the next few years. IMHO maintaining control of the Senate is even more important than who is elected president. It’s time to start playing the long game instead of what is politically popular now..but I’m not hopeful.

If he nominated Colin Powell, he would get confirmed and would get a solid liberal on the Court. Orrin Hatch, John Huntsman, John Kasich, Lamar Alexander . . . . All of them would be pretty easy confirmations and would give Obama 80% of what the hardest leftist judge would give him.
