The Iowa secretary of State on Saturday rebuked Republican presidential candidate Ted Cruz’s controversial use of a mailer to encourage turnout at the Feb. 1 caucuses.

“Today I was shown a piece of literature from the Cruz for President campaign that misrepresents the roll of my office, and worse, misrepresents Iowa election law,” Paul Pate said in a statement released by his office.

What’s a Canadian supposed to know about American Election laws?

“No one needs to think of the story because mailers like this have been going out and been reported on for over 10 years.”

Obi Wan might have been able to pull off a mind trick like “no one needs to think of the story”, but a Jar Jar Binks character like you, never.

“I hear that the Cruz Campaign Headquarters needs some volunteers in Iowa to help stuff mailers. :)”

Yeah, and I heard that a bunch of Trump and Rubio supporters were volunteering! :-)

I never once said the mailers were fake or a trick. I recognized it immediately as kind of a standard, over-the-top marketing effort. I know the letter wouldn’t work on me, but I believe the marketing people when they say they do work on lots of people.

I was surprised to learn the Cruz Iowa State chairman is Matt Schultz, a former Iowa Secretary of State. Shouldn’t Schultz have know how bad this would look to Iowa voters. Didn’t he learn anything when he was the Iowa Sec of State?

If you’re a DEMOCRAT! Conservatives take their duty of voting a bit more serious.

That’s the perfect defense.

“I didn’t know the letter was rude, and invasion of privacy, or misrepresenting the Secretary of State, because I’m Canadian! Eh!”

Indeed. Motivated to vote for anyone BUT Cruz!

Statement from Secretary of State Paul Pate Regarding Misleading Mailer from Cruz for President Campaign

State of Iowa Seal

State of Iowa Seal

DES MOINES - Today I was shown a piece of literature from the Cruz for President campaign that misrepresents the role of my office, and worse, misrepresents Iowa election law. Accusing citizens of Iowa of a “voting violation” based on Iowa Caucus participation, or lack thereof, is false representation of an official act. There is no such thing as an election violation related to frequency of voting. Any insinuation or statement to the contrary is wrong and I believe it is not in keeping in the spirit of the Iowa Caucuses.

Additionally, the Iowa Secretary of State’s Office never “grades” voters. Nor does the Secretary of State maintain records related to Iowa Caucus participation. Caucuses are organized and directed by the state political parties, not the Secretary of State, nor local elections officials. Also, the Iowa Secretary of State does not “distribute” voter records. They are available for purchase for political purposes only, under Iowa Code." Paul D. Pate, Iowa Secretary of State

I think the job for a State Chairman is really to work the inside-baseball part of the game. Make the right introductions, rally and recruit the right fundraisers and supporters, that sort of thing.

I don't think they're involved in the day-to-day running and strategy of the campaign.

I mean, these people are going to destroy the reputation of the Republican Party that will have no small effect in the General, these antics will not be forgotten and will be brought up front and center by the Democrats. These people are building the disaster of a Republican loss to either Hillary or Sanders, when until about a month ago I felt pretty much any Republican could beat Hillary but now, besides that Hillary may not even be the Democratic, whether it is Hillary or even socialist Sanders, I am watching these Beckism nutjobs and these type of antics which just scream lies and borderline illegalities, I mean if thia “team” gets their guy the nomination there isn’t going to be a Holy Saint coming out of the sky performing a magical miracle to win the General, it ain’t going to happen and their guy is literally going to get massacred by the other side and America is not going to elect their guy and even Sanders would bet him. But some of these nutjobs are now destroying the reputation of the Republican party, such that literally all the candidates whoever wins the nomination will be damaged because of these few fools.

Oh thank you and it is a wonderful weekend. I love this politics stuff when it gets here. It is sorta like Christmas.....I get really frustrated in early to mid-December but December 23rd, I am so excited about it. I feel the same way about the primary. It was miserable the last few months but since Thursday I have been so excited. I love the entire process of it. I have had the news on the last couple days constantly. I wish I was in Iowa....lol. It just seems so fun. Of course, I would not participate in the caucus but just be there among the fun would be great. Even though Iowa is not particularly important as far as outcome the last few cycles, I think what is exciting is that we have ZERO idea who will actually win. I mean I hope it is Trump and it certainly looks good with Rubio second and then Ben Carson third and then Rand Paul fourth and the Cruz fifth...............if that were to happen that would be Christmas morning for me.

And while I disapprove of the mailer, it should be pointed out that Secretary of State Pate is a Trump backer.

Irrelevant and immaterial.

You'll have to spin harder and faster than that.

Ted Cruz, the "Constitutional Attorney", the "smartest lawyer in the room", by sending these "Voting Violation" mailers, in my opinion, violated the following federal election laws. Many States have similar laws.

The following is an image of a mailer Senator Ted Cruz sent out intimidating and threatening voters. It contains voter information and the information of the voter's neighbors.

It threatens "follow up notices" with no doubt information about if the voter voted in the caucus.

It attempts to intimidate voters by threatening public disclosure to neighbors of a person's voting record.

One must ask what does Senator Ted Cruz expect the person receiving this notice should do to their neighbors for not voting as Senator Ted Cruz demands, and what might happen to the voter if the neighbors are informed they have not voted as Senator Ted Cruz expects?

These are direct threats and intimidations in violation of federal election, civil rights, and postal laws.

The following PDF document outlines the federal election laws and the government's position on such matters for the purposes of prosecutions in such matters.

Federal Prosecution of Election Offenses Seventh Edition, May 2007

The following sections are from the above document.

42 U.S. Code § 1973gg-10 - Criminal penalties (violation of election law)
A person, including an election official, who in any election for Federal office-

(A) registering to vote, or voting, or attempting to register or vote;
(B) urging or aiding any person to register to vote, to vote, or to attempt to register or vote; or
(C) exercising any right under this subchapter; or
(2) knowingly and willfully deprives, defrauds, or attempts to deprive or defraud the residents of a State of a fair and impartially conducted election process, by-
(A) the procurement or submission of voter registration applications that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held; or
(B) the procurement, casting, or tabulation of ballots that are known by the person to be materially false, fictitious, or fraudulent under the laws of the State in which the election is held,
shall be fined in accordance with title 18 (which fines shall be paid into the general fund of the Treasury, miscellaneous receipts (pursuant to section 3302 of title 31), notwithstanding any other law), or imprisoned not more than 5 years, or both.

18 U.S. Code § 594 - Intimidation of voters

18 U.S. Code § 245 - Federally protected activities
(b) Whoever, whether or not acting under color of law, by force or threat of force willfully injures, intimidates or interferes with, or attempts to injure, intimidate or interfere with-
(1) any person because he is or has been, or in order to intimidate such person or any other person or any class of persons from-
(A)
voting or qualifying to vote, qualifying or campaigning as a candidate for elective office, or qualifying or acting as a poll watcher, or any legally authorized election official, in any primary, special, or general election;

(5)
any citizen because he is or has been, or in order to intimidate such citizen or any other citizen from lawfully aiding or encouraging other persons to participate, without discrimination on account of race, color, religion or national origin, in any of the benefits or activities described in subparagraphs (1)(A) through (1)(E) or subparagraphs (2)(A) through (2)(F), or participating lawfully in speech or peaceful assembly opposing any denial of the opportunity to so participate- shall be fined under this title, or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire shall be fined under this title, or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title or imprisoned for any term of years or for life, or both, or may be sentenced to death. As used in this section, the term “participating lawfully in speech or peaceful assembly” shall not mean the aiding, abetting, or inciting of other persons to riot or to commit any act of physical violence upon any individual or against any real or personal property in furtherance of a riot. Nothing in subparagraph (2)(F) or (4)(A) of this subsection shall apply to the proprietor of any establishment which provides lodging to transient guests, or to any employee acting on behalf of such proprietor, with respect to the enjoyment of the goods, services, facilities, privileges, advantages, or accommodations of such establishment if such establishment is located within a building which contains not more than five rooms for rent or hire and which is actually occupied by the proprietor as his residence.

18 U.S. Code § 242 - Deprivation of rights under color of law Whoever, under color of any law, statute, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexual abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death. It doesn’t matter if he’s a Hillary backer or an Independent....Cruz violated Iowa Voting laws by doing that...

How irresponsible do you have to be to do something like that? And that isn’t the first time he has done things in this arena....how disgusting to the people of the State of Iowa?

You don’t go into someone else’s State and make them look like fools!!!

But some of these nutjobs are now destroying the reputation of the Republican party,

Sorry, but I have to ask, Which reputation would that be?

THe rpeutation for upholding the Constitution? (Gone, almost from day 1).

The reputation for representing Conservatives? (Usually gone by the time the votes are counted)

The reputation for standing up against the opposition in Congress? (Ooops, gone...)

The reputation for reversing the damage done to the Republic by previous administrations? (Ummmmm, not so much).

IMHO, the GOP shat in its messkit a long time ago, when it comes to reputation.

We have been presented with a steady stream of moderates who are lackluster at best, nearly liberal at worst, and who rarely try to do one thing we send them to Washington to accomplish.

That's the good I have to say about the Party. Only the fact that the other Parties are commonly far worse or infused with crackpots even keeps me looking in the direction of the GOP--just because it is the most attractive in the room does not necessarily mean there is anything pretty about it, it only shows how ugly the rest have become.
