This is very interesting, because if the judge finds in favor of the civilian drone operator, it immediately creates a fourth amendment question.

For years now, cities have used photographic overflights of homes to determine if home owners have erected any structure or are carrying out any activity that violates either zoning ordinances or local laws. However, these are manned overflights in helicopters or light aircraft.

So could cities, or their police departments, essentially conduct warrantless searches from the air at much lower altitude. Say a drone appears hovering over your backyard at an altitude of 20 feet, and starts taking video through the windows in the back of your house.

Likewise, could your nosy neighbor do this? Typically a perv who wants to ogle your teenage daughter.

The Drone Slayer is now a local hero. I’d like to get one of his shirts.

Yes and no. Depends if it’s controlled airspace. If it’s in class G then it’s open up to 14,500ft. See:http://www.faa.gov/regulations_policies/handbooks_manuals/aviation/pilot_handbook/media/PHAK%20-%20Chapter%2014.pdf

What purpose would a private individual have in flying a drone with a camera at a low enough altitude to be hit with a shotgun (not very high...I know as an avid dove shooter) and filming someone else’s backyard private property?

Exactly

Question is, just what can a person do for security?

Cover everything!

I remember the aircraft plant in california during ww2 painted the roof of the plant to look like a hillside.

And a smart person can come up with a defensive solution, such as an air cannon that shoots weighted dyneema fishing lines with weights, as a fisherman i can attest to the height i can cast plus the tensile strength of dyneema braid.

Or on a funny enough thought, homeowners launch hundreds of helium filled party ballons in their backyards with crosslinked fishing line, much like again the ww2 barrage balloons.

I believe the federal government are afraid of drones.

How about a bee size drone with a needle?

Just saying the box is open.

Here is another thought, when TSHTF one of the most desired pieces of personal high tech will be drones to search for homes with shelters, ammo, food, fuel and transportation.

Anybody can and will use them, for or against you.

Myself i may get a good intel seeking drone, and another than can go on an anti drone mission. Or many suicide mini drones to take out others.

That’s why I think someone put the drone owner up to the lawsuit. Prolly the federal AG.

"The FAA controls all the air above 500 feet...have for a long time."

With all due respect lacrew, patriots need to check every law and action of the corrupt federal government against the feds constitutionlly limited powers, most of these few powers listed in the Constitutions Section 8 of Article I.

And I can tell you right now that we are not going to find any clauses in Section 8 that reasonably justify the FAAs regulations, particularly since aviation technology was not invented when the Constitution was drafted.

Thomas Jefferson and James Madison had put it this way about the evil (my word) federal government.

If that drone really was at 200 feet (which I doubt) that Dad is a crack shot. :) Aat that range, it is getting marginal for a shotgun to take down anything. I would estimate 120 to 140 ft maximum range for a shotgun/drone kill.

A drone is not a pet that can innocently wander onto my property. It has to be sent there.

If you send it on to my property then you have given it to me and I can do as I like with it.

Including blowing it to bits.

Article excerpt says the drone was ten feet above his house.

"Prolly the federal AG."

Such incremental testing of the federal governments constitutionally limited powers has been going on since the states established the federal government.

I’ve hit clays at 65 yards with #8 shot and broken them, so a tighter choke and some lead #2’s and I think you could get the drone.

George Digweed, a world champion shooter, broke a clay at a measured 130 yards.

Thanks for that. IMO, anyone paying attention intuitively knows those in control of the monstrous government are actively working to enslave us all.

Yes, somehow the feds will find a way to use the always abused Commerce Clause to justify new regs.

I thought about this too, but the public air space doesn’t start until you are 500 feet up.

Nope. a lot higher than that....maybe 18,000 or so feet.

I can tell you the sheriff’s helicopters in Riverside County fly don’t maintain a 500 ft flyover altitude.
