Gowdy: List of Visa Overstays Should Be Sent to Firearms Dealers

Never mind the secret and mysterious government watchlists: The government could and should be sending its list of people who overstay their visas to federally licensed firearms dealers, Rep. Trey Gowdy (R-S.C.) told two Obama administration officials on Thursday.

Speaking at a hearing on foreign travelers and national security, Gowdy said three groups of people currently are barred by law from purchasing or possessing a firearms, including people in the country without permission; people who overstay their visas; and even, in most cases, people who are here on a valid visa.

"Are those lists made available to federally licensed firearms dealers so they can make sure they don't sell firearms to those three categories of prohibited people?" Gowdy asked Leon Rodriguez, the director of U.S. Citizenship and Immigration Services, and John Bersin, assistant secretary of Homeland Security.

"Mr. Gowdy, I'm just not familiar with the ATF process with regard to that," Bersin replied. "I don't believe that DHS circulates those lists," he added.

"Well, this is the frustration that I face, is that I listen to an administration call for additional gun laws," Gowdy said. "They want additional gun control in the wake of almost every tragedy. That's the very first place they run. And it just forces me to ask, well, I wonder how we're doing with the current gun laws that we have?"

Gowdy encouraged both Bersin and Rodriguez "to go back and look at the statistics coming out of the Department of Justice on how many prosecutions exist for current gun law violations in all those three categories.

"And if we're going to create a list with, by the way, no due process, called a watchlist -- then at a minimum you ought to give the list of visa overstays to federally licensed firearms dealers, because that list already exists.

"We already know who's on that list, so your due process rights have already been afforded to you. So if there's going to be a list given to FFLs, I would think it ought to be the visa overstay list before it would be some list conjured up by-- by folks that we're not familiar with."

The San Bernardino shooters were legal, right? Then what are we going to do about pipe bombs? Notify every plumbing shop, hardware store, etc.? It would seem simpler just to follow what Trump says, bam Muslims.

It’s stupid. Make it simple: not a citizen, NO GUN!

The Second Amendment is a uniquely American right that should be reserved for Americans.

Catch an alien with a gun, deport him. If an alien uses a gun in a crime then mandatory death penalty.

Let’s quit screwing around folks.

It’s BS the courts & Congress have decided the Constitution and Bill of Rights cover non-US citizens. Legal aliens of any stripe (temporary or permanent) and all illegals (border crossers, visa overstayers, etc.) should not be permitted to purchase firearms. Nor should they qualify for *any* govt. benefits — welfare, food stamps, SS, SDI, Medicare, Medicaid, instate tuition. Nor should we allow birthright or dual citizenship. Go back to your native country or become a 100% American citizen.

Does this square with the Gun Control Act of 1968? I don’t like it, it’s unconstitutional, but that Act was passed by Congress, and dictates that felons cannot possess guns. Overstaying a visa— is that a felony?

Meaningless. As far as I know, the only non-citizens that can purchase firearms are those that have already been granted permanent resident status.

We FFL’s don’t need no stinkin lists; that should all be taken care of automatically whenever we do an Instacheck. So your stupid idea is to send us an email several times a day with updated lists and EVERY FFL is expected to MANUALLY check these lists each and every time we do a transfer?

NCIC is who any lists need to be sent to, and you should know that, Trey.

Of course, on the other hand, the obama administration might not know that either, and even if they did, they’d much rather carp and whine about gun confiscation rather than take some simple extra steps that might deny their beloved foreign invaders any of their supposed Constitutional rights, though of course, all the rest of we actual citizens should expect to have our firearms confiscated any minute now.

Makes too much sense and doesn’t fit the agenda of Obama, Jarrett and Clintoon to disarm America.

These Visa abusing people should be a no gun buy list and zero benefits from the feds and state governments.

Breakdown the bureaucratic bs and put these rectums on a no buy guns or ammo list, and the only fly list for them is a one way trip out of America.

Monitor and restrict those abusing their Visas and Jihadists and leave the gun restrictions alone.

No. Entering the US without processing or overstaying a visa is a misdemeanor. Also, a person would not be considered a felon until they were convicted of a felony, not merely accused.

Even a licensing requirement for firearms dealers, let alone permitting, purchase restrictions on and licensing of individuals, is a clear violation of the second amendment. If you can’t be trusted to be armed, you shouldn’t be running around loose; if a foreigner you shouldn’t even be here!
