Police: woman likely won't be indicted in shooting (Meridian,MS)

A Meridian woman who police say shot and killed a man who broke into her home Sunday will face a grand jury but it will likely be determined she acted within her legal rights, a police spokesman said Monday.

"… This is one of those instances where the homeowner was trying to protect her life and her property," Meridian Police Department Detective Dareall Thompson said Monday.

Thompson said police responded to the home in the 4400 block of 20th Street near State Boulevard at about 3:30 p.m. Sunday.

"A male subject had kicked in the front door and forced his way into the residence," Thompson said. "The homeowner shot the intruder."

Thompson said the woman was upstairs in her two-story home when she looked downstairs and saw the man in her living room. The woman came down the stairs and shot the intruder, Thompson said.

"He made it out of the front door and then collapsed outside," Thompson said.

Lauderdale County coroner Clayton Cobler said the man had been shot three times in the chest by bullets fired from a .380 caliber pistol.

The body was taken to Jackson for an autopsy. Cobler said said the man's identity would likely be released today.

Thompson said homeowners have rights under the Mississippi Castle Doctrine that states people inside their residence have a right to protect themselves.

"Once they are inside, A, they are trying to do bodily harm or, B, they are trying to take property from you," Thompson said. "Their intention is to do something dangerous. Anybody who forces their way into your home — you have the right to protect yourself."

This is the second time this year a Meridian homeowner has shot and killed an intruder, Thompson said.

Lots of people look down on the .380 but it has sent a lot of people to the ER and put a lot of people in their graves. I prefer the .38 Super myself but not a whole lot of choice when it comes to carry gun and ammo. The advantage of the .380 is that it is small enough to be a “surprise” gun. Not only concealed but concealed well enough that the perp is at close range and is surprised when the gun comes out. New ammo choices for the .380 adds to lethality as well.

5 rules of a gun fight

1) gun beats no gun
2) fast beats slow
3) a hit beats a miss
4) bigger holes beat small holes
5) many holes beat one hole

Last week I called police about a man hiding in bushes close to my house. My dogs alerted me to him and I went outside to look. Dogs were on porch acting scared and when I came out with a shotgun (fire two blasts, with a shotgun), the dogs ran to the area he was hiding in. I then saw him as he started walking down the street as if he was just passing through. He then walked down the street and took a left. After calling police and being told they would have the 1st available officer drive through. Never saw a patrol car. 5 in the morning they aren’t working a lot of wrecks. And they don’t want no paperwork or a chewing out for the city having to pay the county for jailing another homeless. So this woman has killing a man on her conscience while the city officials and policemen are riding the clock. Just wrong. She did what she had to, they don’t do what they need to. In another story on WTOK they talk about a “youth” wanted for shooting in a house and hitting a 14 year old girl(still in hospital). They cant find him.(He’s not in the coffee shops or in their cruisers)He has been in trouble at least 3 times for gun crimes, yet they keep letting him out(no youth detention facility thanks to SPLC. But the city and county are spending 4 million on a 4 court basketball gym so the yudts will have something to do. Two elderly citizens killed by yudts in last year or so. But the 5 youths who kicked a retired teacher to death 3 years ago arer out on the streets. Meanwhile he is still dead.

And likely 10 to 15 less crimes will be committed. These guys don’t just do this once then retire, they make their living this way. Good shooting.

Absolutely 100% agree.

I cant tell you how many (mostly men) people I have met who want to buy some hand cannon thinking that they will be able to use that as their defensive gun. Most only fire them 2 or three sets of ammo and then the gun sits on a shelf somewhere cause it either hurts too much or costs too much to go to the range.

On the other hand, back in the ‘80s, I met a granny who could LITERALLY shoot the eyes out of targets a 50 feet with a .22 pistol. Later I found out that she was in the OSS during WWII. She would come to the range at Ft Leavenworth fairly regularly and stay in practice.

DAMN scarry granny with that pistol in her hands.

The optimistic answer is that it would close the door on further prosecution, but it may simply be that the DA isn’t willing to stand up on the issue for himself.

Good question, and I think that they know full well she will be found to have acted lawfully, but the anti-gunners want to get some harassment in...just because.

That's the advantage of a .38. It still got the job done, but the thug was able to get outside and do most of his bleeding where a hose could clean it up. With a .45 the cleanup would have been indoors.

Hand cannon: Any pistol too large, heavy, or with too much recoil to be effectively used by the individual.

Some may be able to shoot a .50 Desert Eagle effectively.

Most cannot.

It’s like picking the right sized bat in baseball.
