Sen. Cruz: This Is an Important Step Toward Curbing the Federal Government’s Intrusion on States

WASHINGTON, D.C. — U.S. Sen. Ted Cruz (R-Texas) today released the following statement upon the 6th Circuit’s stay on the “Waters of the United States” rule, which allows litigation over the legality of the rule to proceed before implementation:

“The 6th Circuit’s order to halt implementation of the EPA’s new ‘Waters of the United States’ rule is a win for all Americans, but especially for farmers, ranchers, and landowners in the state of Texas. Today’s order is also an important step toward curbing the federal government’s relentless intrusion on the states—power grabs that have become standard practice for President Obama’s EPA. I applaud the states for fighting to preserve their constitutional authority against an ever-expanding federal regulatory state.

“The court’s stay is not a permanent victory.  It does, however, put the breaks on what has become a lawless, runaway federal agency that all too often tramples on hardworking Americans and their businesses.  While this stay does not invalidate the onerous, damaging EPA regulation entirely, it does temporarily halt its implementation.

“Under the EPA and Army Corps of Engineers’ ‘Waters of the United States’ rule, dry ditches that have not had water in them for years – but that may have signs of water once in them – can potentially be subject to significant and costly regulations. This heavy-handed rule could bring virtually every puddle and ditch in America within the jurisdiction of the federal government, allowing it to dictate what people can and cannot do with their own property. 

“Furthermore, regulatory confusion and uncertainty surrounding this rule forces landowners to incur great costs, since it is difficult to comply with a rule lacking clarity. I am hopeful that the courts will use this case as an opportunity to reassert the appropriate balance between the federal government and the states that makes our nation unique.”

Big fight over exactly that issue here in Michigan. A bill to stop prosecuting people for breaking vague regulatory laws has passed the house and is currently in the state senate. Naturally the democrat response is that we just need to hire more people to educate the public about the ever growing mountain of regulations.

What seems to have brought it to a head is a case where a guy built a garage in a "wetland" that is damp every spring and was being fined something like $5000 per week.

Spoken like a true lawyer. I thought he was running to be President.

Not one word about what he would do about the EPA regs as President.

A golden opportunity to state his case and not one word except "I am hopeful that the courts will..."

Just more messages of "hope" (that someone else will do something) from yet another clueless weenie.

I own a historic building with an old gold mine in the cellar that never flooded for 150 years until the Army Corp mitigated a wetland down the street.
No historical or subsurface hydrology studies were done only a charge of $350,000 for the developer to pay to buy more wetland. The developer went broke but the road was completed which then caused flooding in my building (complicated situation)
I am not only left with a permanent flooding problem but the creek these wates used to discharge into no longer get the water that is blocked by the new construction.
Have attempted to demonstrate with competent consultants that the trout stream is also now being deprived of waters for fisheries.
My personal property now sustains continuous damage and maintenance issues because of incompetence, action or in action by the Army Corp.
Environmental regs are more to collect money and jerk around private property owners than to protect the environment.
I am probably the only property to have had flooding issues in California the last 2 years of drought.

Intrusion? The federal government has already gained power over most states, so now the USA essentially has a central government in Washington, and puppet regimes in most states.

Ahhh we got there faster than I had hoped...

I have seen a lot in almost 50 years of experience, and I have worked with many different skilled peopled towards a common objective by leading, coaching, doing and by kicking ass when and whereit is needed to get it done...

I am all about what you have and can do, what you want to do is great so what are your plans that you can share so I can decide...

My vote is precious to me, with a family heritage of service and support for this country pre its acknowledged existence as more than a Colony...

So at the end you can do as you wish, Ted is a great guy and can grow and evolve to provide whatwe need today in the future...

But for my vote as he sits across from me, Not ABOVE me and asks for my vote as pres versus others, specifically Trump...

No doubt, of course, intentionally. It also gives regulators wiggle room to interpret regs in whatever way they want, to sanction whomever they want, and/or to get the results they desire. It's the Democrat way.
