Better that five innocent students get expelled than one guilty student stay enrolled

The view endorsed by Rep. Jared Polis (this passage apparently both as to public universities and private universities, start at 1:57:28):

It seems like we ought to provide more of a legal framework, then, that allows a reasonable likelihood standard or a preponderance of evidence standard [for deciding whether to expel college students accused of sex offenses]. If there are 10 people who have been accused, and under a reasonable likelihood standard maybe one or two did it, it seems better to get rid of all 10 people. We’re not talking about depriving them of life or liberty, we’re talking about them being transferred to another university, for crying out loud.

Let’s apply this standard to politicians accused of misconduct. I mean “We’re not talking about depriving them of life or liberty,” we’re merely talking about them being made to work for a living, for crying out loud.

The problem is that as a society, for far too long we have forced individuals to violate the first amendment. No, I am not talking about the religion clause. I am talking about the assembly clause.

The first amendment guarantees the right to peacefully assemble. And just as the rest of the first amendment includes the negative, i.e. the right to NOT do something, the right to assemble also includes the right to NOT assemble. No one can force you to join a church or book club or gym if you do not want to.

Further, we can assemble for ANY reason as long as it is peaceful. That include for the purpose of business. So The People have the right to conduct business with whomever they want to and they also have the right to NOT conduct business with whomever they want.

In short, any law which requires a business to serve anyone that it does not wish to server, is unconstitutional.

So a dumped girlfriend has the power to really get back at the boy and there’s nothing he can say or do about it. This is more political correctness. We need laws to deal with the proliferation of political correctness.

BTW, what happened to turning the case over to the police? What the university is doing is acting as cop, judge, and jury. But they have no requirement to be legal or just or fair. Just correct.

Collective punishment is ok because Polis is a homosexual. So he thinks that only openly heterosexual men would be affected. He personally would not ever be affected by this, because his excuse would be that he is a homosexual, and we all know that homosexuality is a recognized grievance group.
