Facing a congressional subpoena, a former State Department staffer connected to Hillary Clinton's private email server has decided to invoke his Fifth Amendment right.
Attorneys for Bryan Pagliano, a former State Department staffer who received a subpoena to testify and provide documents to the House Select Committee, wrote the committee notifying Committee chairman, Trey Gowdy that Pagliano would plead the fifth.
Gowdy wants Pagliano to appear before the Benghazi Committee to provide documents related to the servers or systems operated and owned by Clinton.
Mr. Paglianos legal counsel told the committee on Tuesday that he would plead the 5th to any and all questions if he were compelled to testify.
Pagliano's decision was disappointing to the Clinton campaign, which had hoped he would testify about his IT work for the former secretary of state.
Clinton "has made every effort to answer questions and be as helpful as possible, and has encouraged her aides, current and former, to do the same, including Bryan Pagliano," a campaign aide wrote in an email.
But Rep. Elijah Cummings, D-Md., the ranking Democrat on the committee, defended Pagliano's legal decision in a statement Wednesday night.
"Although multiple legal experts agree there is no evidence of criminal activity, it is certainly understandable that this witness' attorneys advised him to assert his Fifth Amendment rights, especially given the onslaught of wild and unsubstantiated accusations by Republican presidential candidates, Members of Congress, and others based on false leaks about the investigation," he said.
"Their insatiable desire to derail Secretary Clinton's presidential campaign at all costs has real consequences for any serious congressional effort." Pagliano worked as an IT director for Clinton's 2008 presidential campaign, and served as a special advisor to the State Department's chief technology officer between 2009 and 2013, according to a LinkedIn profile.

Will this guy appear before the committee and plead the 5th himself...or is he trying to avoid appearing?<p.
He should be grilled by each Republican congressman...and be forced to plead the 5th at least 100 times.
How dumb do they think we are to believe this: “Pagliano’s decision was disappointing to the Clinton campaign, which had hoped he would testify about his IT work for the former secretary of state”?
Pagliano in the near future....
1) Pleads the fifth
2) stays home all day, playing computer games, and watching porn
3) Gets a big check every month
Worked for Lois Lerner quite well.
Call him in.
Ask him clearly non-implicating questions, and watch him squirm.
When were you hired?
What is your name?
What color is your shirt?
Just like B Lehner ,he was a govt employee and should be hauled in and forced to face the cameras and declared in contempt.
She's looking pretty sickly lately.
“What does it matter”
Man...they are taking cronyism to a new level.
She’s looking pretty sickly lately”
I expect another “fall” and the use of her coke bottle glasses
Better yet, deliberately ask him the implicating questions.
“What are you trying to hide from us?”
“Did Hillary Clinton threaten you with physical violence?”
“Have you and Hillary Clinton ever teamed up to discuss ways to destroy legal evidence?
... not answering those questions WILL make him look guilty!
Somebody poked the Lawn Jockey (D-MD) with a stick again. This guy looks like a Black Pit Bull.
“I expect another fall and the use of her coke bottle glasses”
Perfect! Enough grist for Trump to put out more devastating Twitter messages at virtually no cost. Only a billionaire could figure out how to run for president effectively and not spend millions doing it. Dying on the campaign trail would be a “fitting end” for Hitlary!
1-No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger;
2-nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb;
3-nor shall be compelled in any criminal case to be a witness against himself,
4-nor be deprived of life, liberty, or property, without due process of law;
5-nor shall private property be taken for public use, without just compensation.
So which part does he believe his honest testimony will violate?
It looks to me it could only be "3"
So as long as the questions don't involve his personal actions, how can he legitimately invoke it?
Well, this is telling. Two people now plead the 5th! This means guilt.
At least 100 times.
A fork is about the only thing anyone besides Huma would stick in Hillary. Thanks MarvinStinson.
Plus, the Clinton Crime Family will get him if he rats out . . . Rats her out . . . bwaaahaahaaa
The who Rat Party is a crime family
“How much money have the Clintons paid you over the course of your career”?
“Mr. Chairman, I refuse to answer...”
“Would you estimate this was closer to six figures or seven figures”?
“Mr. Chairman, I refuse to answer...”
“In all that time, did you run across any illegal activities with regard to either Bill or Hillary Clinton?”
“Mr. Chairman, I refuse to answer...”
“If Mrs. Clinton claims she *wants* you to testify honestly to this committee, what could you be covering up that you refuse to testify?”
“Mr. Chairman, I refuse to answer...”
“Sir, have you ever cheated on your federal income taxes?”
“Mr. Chairman, I refuse to answer...”
“Sir, have you ever cheated on your wife?”
“Mr. Chairman, I refuse to answer...”
“Sir, do you have any children outside of wedlock?”
“Mr. Chairman, I refuse to answer...”
