Bill O'Reilly confronts Donald Trump: You can't 'deport people who have American citizenship'

Fox News host Bill O'Reilly during an interview Tuesday night repeatedly challenged a key portion of Donald Trump's immigration agenda.

The real-estate magnate and Republican presidential candidate recently unveiled his multipart plan to clamp down on illegal immigration. Among other things, Trump called for ending birthright citizenship, or the right of anyone born in the US to American citizenship.

As O'Reilly pointed out, however, the US Constitution's 14th Amendment enshrines birthright citizenship into US law.

"That's not going to happen because the 14th Amendment says if you're born here, you're an American," O'Reilly said. "And you can't kick Americans out. The courts would block you at every turn. You must know all that."

Trump insisted that the Constitution did not grant citizenship to so-called anchor babies, a pejorative term used to describe the children of people who enter the country illegally with the purpose of having a son or daughter who would then be granted US citizenship.

"Bill, I think you're wrong about the 14th Amendment," Trump said. "And frankly, the whole thing with 'anchor babies' and the concept of 'anchor babies' — I don't think you're right about that."

O'Reilly was incredulous.

"I can quote it!" O'Reilly exclaimed. "You want me to quote you the amendment? If you're born here, you're an American — period! Period!"

Since when has the constitution "enshrined" anything into law? Never stopped Obama.

Can’t deport Americans, no , but he can go after all these companies, tell illegals they will be jailed if they do not go back to the country they came form and apply for a working visa through the embassy there.

That is what legal immigrants do and if these illegals after 1 year have not gone back then they are jailed, fined maybe and certainly sent back to never return under a visa or illegally due to a wall, ditch and increased presence for the border patrol who now can do their job , instead of giving illegals diapers and fod.

Just to show how stupid ALL the faces in front of the camera were this morning before 9am:

There were working overtime to misrepresent the “end of birthright citizenship for illegal alien offspring” into ANYONE born in the usa.

Then one channel rolled out some religious fringe group to say that Trump would lose all Christian votes because all Christian evangelicals support illegal alien amnesty.

I think we can make a phased solution:

1) Re-interpret the Constitution the RIGHT WAY. NO AUTOMATIC CITIZENSHIP for babies born to illegals.

2) Pass a law recognizing #1 above.

3) Implement it.

The only problem is this — do you apply it RETROACTIVELY? or do you apply it only AFTER the law is passed?

On Tuesday’s Mark Levin Show: The argument that an illegal alien can step into the United States, claim legal and political jurisdiction, and confer citizenship to their child is insane. People claiming to be Constitutional experts saying that the 14th Amendment allows birthright citizenship are dead wrong. The 14th Amendment didn’t even give citizenship to Native Americans, why would it give citizenship to illegal aliens? The Constitution is on our side in a second way: Article 1 Section 8, which grants plenary power to Congress to establish a uniform rule of naturalization. We’re tired of being told someone can come into our country illegally, claim citizenship, and we’re told there’s nothing we can do about it. We have policies that promote illegal aliens and illegal alien children more than the American citizen and American child – we’re committing national suicide.

Actually, no. IIRC, that interpretation only started finding currency after a SCOTUS case back in the 1980s.

Probably true that you can’t deport anchor babies who were born here under the current rules. The courts will never allow that.

Trump’s proposal is about the future.

Seriously? Does Blow Reilly think that’s a direct quote from the 14th amendment? Or is he dumbing it down for “the folks?”

Even the authors of the 14th amendment claimed it DID NOT apply to foreigners (or even native american indians) because they are subject to the jurisdiction of their home countries (or tribes).

WRONG! Better read the constitution Bill. The 14th amendment, Mr. “O” has been tragically misused, abused and malevolently reinterpreted to fit the liberal/progressive agenda and support “anchor babies”.

With the right congress and president, half of the SCOTUS could be impeached for inappropriate judicial activism and the 14th amendment could be overruled in cases of “illegal” alien births.

Why do all the propagandists hanging on the 14th amendment never actually quote it?

All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside. No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.

Lying pieces of scum like O'rielly know the letter and intent of the amendment never gave citizenship to babies of foreign nationals (those under the jurisdiction of another country) birthed here, legally or otherwise. He thinks people are too stupid to find the truth themselves, and sadly, in many cases he is right.

I think the 14th Amendment should be repealed. But I don’t think it will be. Certainly not in my lifetime. Therefore I view this is a somewhat of a distraction.

As a Californian, illegal immigration has been one of my biggest issues for quite some time now.

IMHO you really need to do about four things to get a handle on it:

1) Secure the borders.
2) Enforce existing laws.
3) End sanctuary cities.
4) Turn off all magnets attracting illegals to begin with.

You do those four things alone, you would probably solve about 95% of the problem of illegal immigration. You don’t need get into Constitutional issues when we already have sufficient laws on the books to deal with the problem.
