Not good. If true, this means there is a possibility the gun store sold it to him in error. I hope they have good liability coverage.

Someone needs to restate the sequence of events surrounding his getting the pistol. I thought I understood that he didn’t buy it himself, so in that context, I am wondering the relevance of the BG check. Does anyone have better information?

Then the FBI should be able to produce a warrant to the store that sold him the gun to produce the Form 4473 he had to have completed to legally purchase a weapon. It would show if there were fraudulent answers. Additionally, there is still the question how this person would have passed an NICS confirmation by the store.

In reality, I just don’t believe anything the FBI says anymore without seeing conclusive tangible proof.

From what I understand, he was given money for his birthday, which he then used to purchase the gun. His father did not buy the gun for him, and claims he did not know how he spent the money.

Not true. If NICS does NOT deny him, the FFL is under obligation to release the firearm to the person that filled out the Form 4473.

If the FBI calls back later and says, "Wait! He's a felon and should have been denied", I tell them, "I'm following federal law. I HAD to release the gun since you goofed up. Now you get to go and get him. Be sure to bring my gun back to me personally". Click.

When you don’t have a CWL in states that have permission to bypass NICS checks, the gun is held until a passing confirmation by NICS is given (an actual number IIRC back when I didn’t have a CWL). Even before this, the Form 4473 is scrutinized. If any of the trigger questions are wrongly answered, the dealer won’t even get to the NICS check.

Given this is the FBI, I’d want to see real, I could touch it, proof.

What kind of responsible father would buy his son a firearm, knowing that his son was on powerful, psychotropic drugs that have a long history of being known to cause violent outbursts?
