A robbery suspect was killed and his apparent victim was wounded late Sunday in a shootout outside a Benihana restaurant in North Dallas.
Witnesses said two men were leaving the restaurant when the gunman approached and asked for a lighter. The robber then put on a mask and pulled a handgun from his waistband, police said.
One of the victims pulled out a gun from inside his Chevy Camaro and exchanged fire with the would-be robber. Police said both men were wounded in the exchange.
The 28-year-old suspect was taken to Medical City Dallas Hospital and died soon after. The wounded man, who is 30, was taken to Texas Health Presbyterian Hospital in Dallas and was expected to recover. Neither man was identified.
Initial reports suggested a second robber fled and remains at large, but police could not confirm that.
The shooting is still under investigation and will be referred to a grand jury, police said.

Why a grand jury? Couldn’t it be a rallying point for thugs looking for a cause?
In this case, it's an open-and-shut case of self-defense, especially since the victim was wounded by the perpetrator. It's pretty obvious that he was justifiably in fear of death or serious bodily injury.
Not clear on the concept, is he? "Ready, fire, aim!"

Good news to start a Monday. Heal quickly intended victim!
Important notes:
1) Robber used subterfuge to close the gap with his intended victim.
2) One of the victims was able to *quickly* recover his gun from his car. Most people keep their gun in the glove box, but he likely had his in the door pocket (most manufacturers call it the map pocket), which also allowed him to partially conceal his brandishing of the gun. The open door would also be “better than nothing” cover if you could use it.
3) Pulling a gun from the map pocket also probably meant that he fired at belt buckle level, which has high mortality.
4) The robber did not want to shoot, but rob, and was making the mistake of trying to “aim two targets”, the two victims, instead of aiming at either the closest *or* the more threatening.
