What Part of ´No´ Does HHS Not Get?

The Supreme Court has again thwarted the Obama administration’s illegal crusade to coerce employers into violating their religious convictions. Late last Wednesday, Associate Justice Samuel Alito stayed an order secured by the administration in a lower court that would have forced several Catholic organizations to comply with Obamacare’s contraception mandate. Despite a high-profile Supreme Court defeat last June in Burwell v. Hobby Lobby, President Obama’s HHS bureaucrats and lawyers have continued their attempts to bully obviously exempt entities into obeying the mandate. Justice Alito’s action constitutes the fifth time SCOTUS has been compelled to rein the government in.

The Court has found it necessary to issue similar orders protecting Little Sisters of the Poor, Wheaton College, the University of Notre Dame, and of course Hobby Lobby. This latest stay shields a number of organizations based in Pennsylvania, including charities, schools and social service operations associated with the Catholic dioceses of Erie and Pittsburg. It also requires the Obama administration’s lawyers to provide a justification to the Court, “on or before April 20,” for their threat to fine these institutions for refusing to acquiesce in the mandate. Obama’s lawyers will have to explain how this group of organizations is any different from the others to which SCOTUS has already granted relief.

The Federal Government is now a criminal organization. Freely picking and choosing laws to enforce or disregard.

For any agency controlled by the Executive Branch, the word of Obama trumps actual law. They are, in effect, our enemy.

Might not have had to “rein [them] in” had the weasel John Roberts not changed sides at the last minute to declare this abomination constitutional in the first place.

It's going to have to be fought out organization by organization in the courts. These decisions, even USSC decisions are effectively good only for the individual cases. They are supposed to decide for the category in the jurisdiction of the court making the decision but if the government ignores that then it has to be done all over again for each charity or church unit. I suspect that pretty soon each unit will face the same attempt s even after it has won in the court. That's suing them into bankruptcy. The Court makes a decision but it is up to the Executive to enforce that decision and the precedent now, one that Congress has accepted, is that the Executive doesn't have to enforce anything it doesn't want to enforce. The Executive can ignore the courts if it so chooses.

Congress is the key, As Congress gives up its power to the President it undermines the Judiciary at the same time and gives over the powers of the judiciary to the President. At a certain point that we may have already reached, Congress can no longer get its power back.

Can anyone imagine a conservative president (wildly unimaginable in itself) persecuting leftist organisations like this, ignoring the court, and having the media ignore its persecutions all at the same time? Neither can I.

Equal Justice Under Law is a phrase engraved on the Supreme Court building. However, court rulings ensure anything but “equal justice”.

I find it incomprehensible the Court is selectively determining which organizations are “exempt” from certain provisions of Obamacare while I, and individual citizen, am not exempt from any provision a law which limits the individual liberty the Constitution is supposed to protect. In fact the Court allows the president, with impunity, to decide which parts of the law he wishes to enforce, delay the execution of, or even eliminate. Meanwhile, I must abide by every provision the president chooses to enforce.

I purchase an individual plan. The law forces me to purchase a plan, purchase services I do not desire or require, and purchase services which I may object to on moral grounds. I have no choice other than to pay an onerous penalty should I not comply.

I’m sorry but I cannot condone the Supreme Court permitting selective exemptions to religious organizations. The Constitution was written to protect individual liberty, not the progressives of organizations. To have “equal justice” the Court should rule all citizens must comply with the law or should it should strike down the law entirely. We cannot have “equal justice” when some are subjected to the heavy hand of government while others are exempted.

Roberts and the Court should have ruled the law was an unconstitutional infringement on prerogatives of the states under the 10th Amendment and a violation of the equal protection clause of the 14th since it did not apply to all citizens. To continue litigating, and permitting exemptions for religious organizations is a farce. There is no “equal justice under law” in 21st century America.

Add to that that certain individuals, including the Congress (lawmakers) of this nation, are also exempt.

It's why all levels of government are able to destroy us. They can get a "no" vote or a "no" decision from judges nine times, and if they get their way the tenth time, there's no turning back.

Would being able to sue elected judges, judges nominated after hearings, and elected pols for breach of promise when they violate their promises help? As it is now, the deck is hopelessly stacked against the will of US citizens.

There’s ZERO chance that this regime will follow anything but its own dictates. Therefore, it is incumbent upon the citizens to delay, deceive and denounce any efforts by the regime to impose rules contradicting our inalienable rights and the Constitution.

The natural outcome of destroying the Constitution is dissolution of the Union and secession.

Suing doesn't work any more. Look at gay marriage, which is supposed to be a state's issue. Look at how the courts enable the invasion of the US, which violates a distinct government obligation to protect us from invasion. The corrupt courts would just throw out lawsuits that the gov doesn't like.

Mygosh, look at Obamacare. It was Justice Roberts, a George 2 appointee, who traitored us on that.

Glad to see someone other than myself refer to adherents of “ROP”correctly. They are truly Mohammedans since they follow Mohammed. Just as followers of Christ are referred to as Christians. And followers of Buddha are referred to as Buddhists. And followers of Shinto belief are referred to as Shintoists.
