Neither Sens. Rand Paul nor Marco Rubio signed a friend-of-the-court brief asking the Supreme Court to allow the question of marriage to be decided by the states. Ted Cruz is the only announced presidential candidate from the Senate whos signed the brief which was joined by 57 members of congress, but only only six Senators.
The brief argues that that based on the ideas of Federalism the issue of marriage has traditionally been left to the states and that is where the Supreme Court ought to let it stay. [O]ut of deference to the States as separate sovereigns in our system of federalism, this Court should be reluctant to intrude into areas of traditional state concern, especially the law of marriage and domestic relations, the brief argues.
The brief quotes the recent Windsor decision where this Court emphasized the States authority to define and regulate the marriage relation without interference from federal courts.
The states have traditionally been viewed as the laboratories of democracy and therefore the issue of marriage needs to be worked out there, the brief argues:

This is a sure RINO litmus test. Guaranteed.
If I understand Cruz correctly, he is trying to do something that I support about abortion and gay marriage, fight it at all levels, and in any way possible, multiple fronts including state, federal, city and county.
Cruz supports DOMA, and Paul opposes it.

So far Cruz is the only one who backs up his positions with action. He’s the only one who supported the Religious Liberty Bills as well.
It should be remarked to the SCOTUS that the most powerful advocates of homosexual marriage is *not* the people, *or* the individual states, but a relatively small group of federal judges who are *thrilled* with the idea.
Thrilled enough to force 230 million Americans to do what they want.
So this decision by the SCOTUS goes beyond the argument itself, to requiring a directive from the SCOTUS chastising these federal judges for their dictatorial arrogance, and directing them to determine the constitutionality of the law, *not* to make it themselves, *and* to defer to the states and the people, that *they* have the right and authority to determine the law and what is constitutional as well, *superior* to that of federal judges.
The real conservative makes a stand, and the RINO Roaches scattered when the light of truth is shinned on them..
Rand Paul and Rubio are for gay marriage no matter how much they pretend to be conservative...
TED CRUZ is the ONLY true conservative in this race...

Paul and Rubio are like little boys compared to Cruz. Whiny voices, no balls to stake out a position and stick to it, easily flustered, etc... They will be just also-rans soon.

Please bear in mind that there would probably be all different faces on the Supreme Court at this time if state lawmakers hadnt ratified the ill-conceived 17th Amendment, foolishly giving up their voices in Congress by doing so. Not only would Obamacare probably have been found unconstitutional by the Court, but there would be less of concern for how conservative justices would decide the constitutionality of gay marriage, likely clarifying that marriage is a 10th Amendment-protected state power issue.
The 17th Amendment needs to disappear.
I believe the only way to restore marriage in the United States is through a full Constitutional Amendment.
