In matters of gender, I tell my students that culture (such as it is) is attempting to trump biology.
So “Gender Identity” is fluid and subjective, but sexual orientation is fixed and immutable, eternally carved in stone. If you are gay, you cannot change to heterosexual. Stories of formerly gay men converting to heterosexuality are bigoted right-wing homophobic propaganda.
Since it is fluid and changeable and not a criteria for marriage or bathroom access, remove it altogether from paperwork.

Generally speaking, we understand when someone misuses the word gender when referring to human sex.
However, using the word, gender, in law creates a problem. Gender has only to do with grammar and has nothing to do with human sex. There is no such thing as transgender in humans. The word regarding humans would be transsexuals.
