Me too. The general trend has been to loosen laws or enforcement upon the users of illegal drugs, while making it tougher on those who need and acquire their drugs legally.

Has it been by the Federal courts? The problem is Uncle Sam’s finger in the program. He can attach whatever strings he wants. To opt out of the Federal bennies might be the only way a state could go on its own.
It was tried, I believe, in Florida and they calculated that it was not saving as much as it cost. One could make moral arguments for it, but probably not economic ones (the same goes for restricting SNAP to a tiny list of foods).

If Industries and Major Companies, as well as small businesses, require drug tests for employment, why cant the Government require drug testing for people they are paying and giving benefits? Because the Constitution protects us from illegal search from the government, not from private industry. The government still needs probably cause, hence the reason why some states rely on screening of some sort before deciding who to drug test.

Nope its legal. It just passed in MI too. A judge struck down the Florida plan which is just like the Michigan plan. I don't think the Michigan plan will survive either.

The Fla law didn’t offer treatment before kicking them off.
It also was required without probable cause. In MI the law will require testing of those suspected of drug use.
Only those that refuse treatment are kicked off.
The Fla law also let them know far in advance when they would be tested. That is why they didn’t catch many.
In MI if they are ‘suspected’ of drug use they will go right then to be tested, just like employers do it.
