Bar owner: Video supports Texas City police account of shooting

TEXAS CITY Accounts differ about how Carlton Wayne Chimmy Smith, 20, came to be holding a handgun when police responding to a call about a crowd arrived at a notorious nightclub early Friday morning.
Police said Smith had been firing into the crowd leaving H.T.s Lounge, 6204 FM 1765, as a Christmas bash was ending about 1:30 a.m.
Some friends and relatives said Smith had taken the gun away from another person, who had been shooting into the air, and was holding it with no ill intent.
But police and witnesses agree Smith was holding the gun when the officers arrived.
The clubs owner had called police because people were slow to leave and were lingering in the parking lot, Capt. Joe Stanton said.
Three officers arrived to find 100 or more people and a disturbance, Stanton said. Soon, they heard gunshots, Stanton said.
A six-year veteran patrol officer confronted Smith and warned him to drop the gun, police officials said.
He turned, pointing the pistol at the officer, who fired, killing Smith, police said. Officials have not said how many shots the officer fired.
The shooting led some people in the crowd to throw rocks and other objects at the police.

You can surely add, "He would never go to a bar and drink. He was a spiritual boy who went to church several times a week. He was such a sweet kid. He would never harm a flea."
Firing a gun into a crowd in a bar parking lot at 1:30 AM, usually doesn't end well.

Once you point a weapon at an armed person regardless of them being a police officer or a legally armed citizen you are very likely to end up dead.
During a disturbance call, drunk, and stupid. End of life decision.
I doubt he took any CHL classes because they cover this.

Yep. The only difference is that the “legally armed citizen” is very likely to go to jail. And face a lengthy and expensive
fight with the court. Probably a 50/50 chance that he goes to jail.
Other than that, it’s the same thing.......
Game over, right there. It may be an incredibly simple decision, an unconscious/unintentional move, whatever. At that point though he is a deadly threat to the officer. I would consider that a deadly threat if someone pointed a weapon at me.
Important lesson to gun owners here.
I had a friend who was a master sword maker. He told me that because of stupid people, he was also an expert at getting a sword out of someone’s hand before they could hurt someone else. He would sell swords at an SCA event, for example, and some guy would ask to see a blade, while standing in a crowd, mind you, and start swinging it around “to test it”, oblivious to the other people. So the sword maker was always ready to snatch a sword out of the fools’ hand.
I mention this because there are any number of fools who behave foolishly while holding a gun. And being a responsible gun person, you may want to snatch the gun out of their hand before they can hurt someone.
Okay, but *then* what happens?, is my point.
Importantly, this may likely not be *your* gun, but someone else’s, and you have just snatched it out of their hand. The first inclination is feeling in the wrong.
Don’t. Your first inclination should either to be to remove the magazine and clear the gun safely, or to open the cylinder and pour the bullets into your other hand.
If they want to get snooty about it, which is likely the case since they are a fool, take the hit. Just be very clear and loud when telling them that guns are not toys, so do not play with them in an unsafe manner. No gun play.
And, as in this case, be very careful to not unthinkingly brandish the gun yourself. So after the bullets are out, hold the gun in a non-threatening manner.

Yes, expert, unbiased ‘eyewitnesses’ said the innocent, youth, child, rising star on his way to church, was shot in the back many times as he was running away from the scary, nasty, mean cops .
“Smith’s family is not convinced by that version of events.
“Then why was he shot in the back? That’s what a witness said,” Quintina Block, Smith’s aunt, said.”
“The police come from the back and just start shooting with guns pointing range and killed him,” said Smith’s cousin Charleston Harris.
Though relatives say Carlton Smith would never shoot an officer, surveillance video may call that into question.
An eyewitness who doesn’t want to be identified says she was standing beside Smith when he was shot by the officer, she claims, from behind and without warning.
“He was like probably five inches away from me,” that witness said. “He was up on him, but he shot him.”
Other eyewitnesses, too, are refuting police claims that Smith fired the gun. They say he might have been holding it, but say another woman had shot in the air previously to end the parking lot fight.
“The girl had the gun,” a witness told us. “Why’d they kill him?”

“Authorities say the officer told the suspect to drop his weapon. The suspect instead turned and aimed the weapon at the officer. The officer opened fire, and the suspect was pronounced dead at the scene.
Police say upon arrival, they saw the man they eventually killed shooting a gun in the direction of patrons exiting the club.
As an officer approached, Texas City Police Chief Robert Burby says the man made a fatal mistake.”
No wonder he was shot....wearing an Oakland Raider ball cap in Texas...
