Jonathan Gruber, Extremely Smart Person

In an oped for Politico, I explain why ObamaCare architect Jonathan Gruber’s 2012 admissions that “if you’re a state and you don’t set up an Exchange, that means your citizens don’t get their tax credits” matter to the ongoing litigation over the Obama administration issuing those subsidies in federal Exchanges, and why Gruber’s attempts to explain his own words away are not credible. Shortly after submitting that piece, I learned Oklahoma Attorney General Scott Pruitt found Gruber’s remarks relevant enough to ask a federal court hearing one of those cases to take notice.

Gruber’s repeated remarks contradict the Obama administration’s legal argument, made in Halbig v. Burwell and three related lawsuits, that it is implausible that Congress would have conditioned those subsidies on states establishing Exchanges. His remarks likewise contradict the amicus briefs Gruber himself filed in two of those cases.(Here’s my response to those briefs.) From my Politico piece:

Jonathan Gruber doesn’t “flake.” He knows this law in and out. He knew what his words meant, with all their implications, when he spoke them. He knew the feature he was describing essentially gave each state a veto over the PPACA’s exchange subsidies, employer mandate and to a large extent its individual mandate. He knew that could lead to adverse selection. To claim Gruber didn’t know what he was saying is as absurd as saying a conductor might fail to notice that the brass section suddenly stopped playing.

Supporters of the Obama administration have downplayed Gruber’s comments because he is not a member of Congress. Nevertheless, he played a larger role in writing the PPACA,.....

I like watching the left crumble. It’s been a long time coming imo.

What I don’t see is the analysis of the big picture over the last 20 years...

How the liberal biased media began losing its chokehold on information w/ talk radio and internet==>

How this accelerating loss of control led to increasingly one-sided bias in attempts to retain control over the political landscape.==>

How such extremes in bias prevented the media from doing its job at all in 2008 resulting in an idiot as president ==>

How such extremes in bias prevented the media from doing its job in reporting on 0bamacare, Benghazi, IRS, EPA, etc ect, etc ==>

With more internet, radio, and at least one big media company now reporting [as opposed to propagandizing], how much longer can the “old” media survive?

Didja see FOX ratings on election night?! Beat the others like a borrowed mule. Even beat the broadcast nets. IIRC they had more viewers than all others combined or something ridiculous like that.

I’d like to see/hear a Krauthammer or Levin or Limbaugh discussion of the media’s role in this fiasco we call the 0bama regime.

Dachau Concentration Camp was opened on March 22nd, 1933. This is less than two months after Hitler took power on January 30th, 1933. And it took longer than 3 months for Hitler to gain control over German Media.

If anyone reads the article by Cannon, they will see why the SCOTUS took this case and why the subsidy portion of obamacare in 34 of the 57 states is dead meat.

No sane person, regardless of profession {even lawyers} can come to any other conclusion.

If a certain Chief Supreme Court Justice is being black mailed, then I'm not sure how the verdict will end.

It depends on the left Justices voting for the Constitution. If Ginsburg, for instance votes properly then Roberts won't allow himself to be in the minority and will vote the right way.Without some help from the Left side, the Sultan's inducements or threats might well put him on the same side he took before. Roberts is, at best, unreliable,
