A federal judge in Arizona ruled Friday that state officials must recognize the marriage of two men who were wed in California this year, though the ruling will not affect the ongoing fight to overturn the state's ban on same-sex marriage, court filings show.

In a 14-page ruling, U.S. District Judge John Sedwick found that Arizona officials must recognize the marriage of John McQuire and George Martinez, who were wed in California in July.

Martinez died of a terminal illness this year, and McQuire was demanding that Arizona officials release a death certificate recognizing him as Martinez's husband.

"Couples in America should not have to play 'now you're married, now you're not' depending on which state they are in when a tragedy strikes, and states should not pick and choose which marriages they will respect and which they won’t as if we did not have one Constitution protecting all of us," Evan Wolfson, president of the same-sex marriage advocacy group Freedom to Marry, said in a statement.

that’s cute.

federal judge has no authority over state law. none.

looks like its time for that judge to have some special taxes levied on his property

Agreed.

That decision should be nullified. We are not the “state” of America, but the United States.

A simple “no” to the tyrant in a black robe should suffice.

Only if the state is willing to fight.

The sodomite is just trying to make Arizona do something he knows it is loathe to do by virtue of its moral stance on the subject homosexuality and the compounded perversion of homosexual marriage. Arizona should hold out for the second half of the sodomite pair to die of AIDS, too, so that the whole issue becomes moot. Simple solution to a perverse problem.

So much for "States's Rights". I guess the "state's rights" argument is only valid when it's used to block a marriage amendment to the US constitution.

Homosexuality is a judgement on America.

This needs to be pointed out consistently - homosexuality will not just bring judgement upon our country; homosexuality IS the judgement. Romans 1:26 starts with “For this reason” and continues “God gave them up to vile passions.” “..men with men committing what is shameful”; so this is a judgement upon our society.

It also continues and says that they give approval to others for more and more evil acts. We see this today with our legislatures accepting
homosexual marriages and the teaching of it as acceptable in the schools.

Note also that Romans 1:32 points out that those who approve of such conduct are just as guilty as those who engage in it.

So much for that whole ‘States Rights’ position staked out by Rand Paul and others.

We need an amendment to the constitution to settle this matter, or we need to leave the union.

If he can ‘get away’ with this, why can’t a ‘friendly’ judge order that CA accept the rest of the Country’s Concealed Carry Permits.

Those states are just as sovereign and if it is that easy to FORCE the citizens of AZ accept Bob and Ted as a married couple, AZ should be DEMANDING that CA, NJ, NY, and the rest of those states that DON’T recognize something that is in the Constitution.

Yes, maybe it does not EXACTLY say in 2A that I can specifically carry a weapon BUT my right to carry a weapon sure is a lot clearer than someones right burn the flag of my Country, perform abortions or marry your pet goat.

If this, then a concealed carry permit from would have to be recognized in another state.

Arizona should basically tell this “Judge” to go pound sand, IMO.

They wouldn’t do this garbage if the conservative right wing population would all at once stand up and say no more. Tough shit. Pound sand. They would shut up. Our inaction is the only reason America has fallen. I am convinced of that now, they play for the win, we play for the no hurt feelings.

if this will be the precedent, then all state ccw licenses are valid nationwide. every state law will have to be recognized by other states.

of course that would be chaos.

but it’s the logical extension of this ruling.
