WICHITA, Kan. The Sedgwick County District Attorney is alleging that a foster father was high while a baby was left in a hot car last week. She later died.
Sedgwick County District Attorney Marc Bennett read the allegations during a bond reduction hearing for Seth Jackson on Friday afternoon.
Bennett said that Jackson had run out of marijuana on the morning of July 24. That afternoon, he reportedly took two children to meet with his drug dealer where he bought more.
When he got home, Bennett said he left the 10-month-old girl in the car, went inside and smoked marijuana. He didn't realize the child was still in the car until more than two hours later, but she was already dead.
Since he believes Jackson was high on the day she died, he supports the higher bond amount. Even with the first degree murder charge, Bennett does not feel Jackson is a flight risk.
Jackson can be free on a $50,000 surety bond. Jackson's attorney, Les Hulnick, told KAKE News this is the first he's heard of the marijuana allegations. He also called the first degree murder charge "ludicrous." He expected Jackson to bond out of jail before 5 p.m. Friday, but as of 10 p.m., his bond still hadn't been posted.
Jackson's adopted children are now in state custody. Other children he and his partner were fostering have also been removed from the home.
Department for Children and Families Secretary Phyllis Gilmore released another statement following Friday's developments:
Should the allegations prove to be true, I am appalled that a precious, helpless child suffered such an unthinkable death while her foster parent was allegedly using drugs. We expect parents to protect and care for their children. We expect even more of our foster parents. They have a duty to put the children in their care before themselves always and provide a loving, safe environment. This incident is a rare exception to the otherwise strong record of foster care safety in Kansas. Drug use is not tolerated among our foster parents.
I guess if you are a foster child your life isn’t worth sh*t in the eyes of The State.
But hey, it’s no more harmful than alcohol, right?
And it’s “just another lifestyle” Who are we to judge those that want to smoke dope?
Our daughter was in foster care in Kansas before we adopted her. The system worked for her. She was with a wonderful family for 11 months. We kept in touch for a long time. I need to call them.

This is that NOTHING-TO-SEE-HERE story of the two gay guys with a ***houseful*** of kids supplied by the state.
So two guys live together and foster multiple children for which they receive subsidies that they then use to buy drugs. Great. Kansas does need to change the policy of singles being able to foster and adopt children. Google Andrew Ellmaker.
Long story, I’ll try to keep short
About 40 years ago, my wife and I were foster parents, one of our foster children was 3 year old Carmen. We had taken all the children to the park and for a scant few seconds, nobody had an eye on Carmen. I saw her out of the corner of my eye, about to walk in front of my 5 year old son, who was swinging on the swings.
Too late to react in time, his foot kicked her squarely in the mouth, she was crying and bleeding profusely, we rushed her to the nearest E.R. and I carried her in.
The nurses tried to take her from my arms but every time they did she started screaming again, I knew they wanted to get her alone so they could question her and I had no objections. My son had already told them that he had accidently kicked her. However, Carmen objected to being separated from me, so the nurse allowed me to go into the exam room and hold her.
The kick had caused her to bite her tongue, hence all the blood. It aggrieved me, probably out of proportion, that while I was holding her, they pulled her pants and panties down, to look at her vagina. I asked them why did they think she was clinging to me so tightly, if I were her abuser. They had no answer as to why little Carmen wouldn’t let go of me. I told them it was because she knew that I love her and she loved me in return.
Then why aren't nazi death squads kicking in doors for alcohol? Plenty of cheeruns have been maimed killed and scarred for LIFE because of booze!
You can't have half prohibition and NOT be a hypocrite! You can't be a half nanny statist either! Fascist!
On one hand I can understand how awful that would be - to be silently accused - on the other hand, after so many rotten things have happened to kids what if they had not tried to check?
Good on you for being a great guy!
That’s a terrible story! Unbelievable! Infuriating - to me, anyway.
KS is in need of drastic reform, but Bob Dole is still in D.C. and out of office. Where is Bob?
So every time a child gets hurt or cries, her pants should be pulled down and her little legs pulled apart to look for sexual abuse???? I think that’s obscene in itself!
What a total disgrace. Two Perez Hilton types are able to adopt 5 children while high as kites. I shudder at what else has gone on - especially when they were high as kites.
Adopting and fostering was the way these two made their living. Poor black kids are fostered by homosexuals often. They come with a chunk of moneys, so do the fosters.
So five kids? at least 10K per month plus travel time reimbursement, all health care paid for and I am pretty sure food stamps included.
In the one photo I saw, the kids were white and blond. A least two pretty little boys.
life ain’t perfect.
and no, I didn’t say that - but what - you think they should NEVER check?
“Adopting and fostering was the way these two made their living. Poor black kids are fostered by homosexuals often. They come with a chunk of moneys, so do the fosters.”
Common in the ghetto in general; money for the kids is spent by the “parents”.
The new normal. If they had been CHRISTIANS, on the other hand, they would have been treated as abusive haters--totally unsuitable to care for children.
“But hey, its no more harmful than alcohol, right?
And its just another lifestyle Who are we to judge those that want to smoke dope?”
How about alcoholic and drugs are BOTH harmful in many ways.
Not surprisingly, Christianity (temperance, prohibition), Mormonism, and Islam have decided against alcohol.
I’m not against alcohol, but I can see the harm it has done, does today, and will do in the future.
Drugs the same.
