U.S. Magistrate Judge Candy W. Dale has denied Gov. Butch Otter's motion for a stay on her decision overturning Idaho's ban on same-sex marriages.
After Dale's ruling on Tuesday, Otter requested that an emergency hearing before Judge Dale take place before noon Wednesday on his request for a stay. Otter asked that no marriages be permitted until "completion of all appeals."
Dale denied both of Otter's requests.
“Judge Dale’s denial of the state’s request for a stay of her decision on same-sex marriage is regrettable in light of the Supreme Court’s decision to stay a similar case, but not surprising. We will appeal to the 9th Circuit Court,” said Otter.
Otter said today he will file motions for an emergency hearing and a stay with the 9th Circuit Court.
Attorney General Lawrence Wasden is preparing his own request for a stay, which should be filed today. Wasden is also preparing to file an appeal with the 9th Circuit Court of Appeals.

The state should just say NO. Why do they obey unconstitutional diktats of an imperial court instead of just saying they won’t comply?

The next time the Supreme Court takes up the issue of homosexual marriage, they will probably issue a sweeping ruling for 50 state homosexual marriage.
It seems clear now, that the only people in America who are allowed to define marriage will be federal judges.
The federal courts hare utterly and completely politicized, and therefore corrupt.
No state should have to obey anything they say.

Remember when courts allowed legislatures to get involved after they made these decisions, in order to implement them without the chaos that will ensue with these sharp decisions?

Kootenai County Clerk Jim Brannon is currently running to keep his position to which he had previously been appointed. He’s a very devout Christian and rock-ribbed conservative. It wouldn’t surprise me if he refused to issue marriage certificates to homos. This could get interesting.
