TAMPA, Fla. A 28-year-old mother of four has filed a lawsuit against a background check website, saying the company used her attractive arrest booking photo for commercial and advertising purposes, without compensating her or even getting her permission.
Meagan Simmons of Zephyrhills filed the lawsuit in Hillsborough County Court against InstantCheckmate.com.

I see her every day on the AccuWeather home page...they try to tie her to some crime here in Red England, but I knew it was BS because half-way attractive women are few and far between up here.

28 year old mother of four? I’ve seen this ad on some sites and I would have guessed very early 20s.

Interestingly, if you search "beautiful mug shots" her face appears in the third row from the top.
More likely a 90 percent pardon with a finish in the sink.

Have seen that pic hundreds, if not thousands of time on commercial web sites.
I think she is certainly entitled to quite a bit of compensation. If she got even one dollar for every page it showed up on, she would be a very weathy woman.
After all the “not guilty” pronouncements, perhaps some consideration of the issue at hand is in order.
Does she have a case here? My impression has been that mug shot photos are public domain, thus free to be used by any party for any purpose without compensation owed to the one photographed. Otherwise, for example, all celebrity mug shots could be a stream of revenue for them.
So I don’t see where or how she has much of a case. Maybe she’ll think of this again before she has a few drinks before driving (assuming she was guilty of that charge, reading here though apparently she wouldn’t be guilty of torturing a puppy even if caught doing so).
In the newspaper today they talked about the lawsuit.. and someone said ‘Guilty of breaking and entering my heart’.

It appears FR men are very, very easy or very, very blind. This woman is not the least bit hot. Looks way older than 28. I think a lot of men have “hit” her.
I’ve seen this woman’s picture in nearly every “Who’s been arrested?” paper I’ve seen....she has a case.

In a case that is general in nature, maybe. However, in many cases where one’s zip code is tagged, IP address are tagged, or visit to a local 7-11 and sees the “who’s been arrested” rag, HER picture is nearly always there.
IMO, it is not fair and open public use. It is pandering because of her looks. Were I on a jury for a suit she filed, she’d prevail.
