The Roberts Trap Is Sprung

One of the most overlooked aspects of the year just ended is the vindication of Chief Justice John Roberts -- a vindication that showed up as the national catastrophe known as ObamaCare got rolling. Roberts may have also doomed Hillary Clinton's chance to live in the White House again.

The chief justice, an appointee of President George W. Bush and reputedly a constitutionalist in his jurisprudence, set his diabolical trap (diabolical to Democrats) on June 28, 2012, when he joined with the four liberal justices on the Supreme Court to uphold the constitutionality of ObamaCare. Conservatives and Republicans across the land were apoplectic. But in hindsight, it appears that Roberts actually saved the Republican Party from going into a death spiral and imperiled the Democrats instead. This suggests amazing foresight, but it wouldn't be the only instance.

For example, Tevi Troy, a scholar at the Hudson Institute, made a remarkable prophecy a year and a half before the Court's decision. It was soon after the November 2010 midterm elections, in which Democrats in Congress and in state legislatures suffered huge losses. In an article in Commentary magazine, Troy wrote:

The Pyrrhic victory Democrats secured for themselves [when President Obama signed the Affordable Care Act into law] may prove not to have been a victory at all but rather an ever-roiling, ongoing, and recurring act of political and ideological self-destruction.

How's that for prescience?

When the Supreme Court ruling came down, a shocked conservative historian, Paul Rahe, cited as a cause the PR pressure that President Barack Obama had been exerting on the Court in the fevered weeks leading up to the decision. It was "an act of judicial cowardice," he fumed. But then he added, "There is, I am confident, more to it than this."

Is it also true that the citizens of those States that chose not to set up exchanges and/or expand Medicaid can’t be charged the penalty (tax)?

By the letter of the law, yes.

The IRS has nonetheless written regulations allowing them to do so.

I believe this is also being challenged in court.

At any rate, the IRS has no way to enforce the fine. If you don't pay it, they have no way to collect it -- other than deducting it from any refund you might be due.

Obamacare was 2700 pages of bad law, poorly written. As Nancy Pelosi said...

BINGO! What a crock of shite this story is. There is not even a tiny bit of win in the SC decision, IMO. If Roberts wanted to impress me, he should have upheld the Constitution, as he swore to do. He was a cowardly failure.

U R right! The GOP just funded Ocare via the budget... thank you Ryan et al. The GOP sees it for what it is. The O-care contracts are awarded based on contributions to the Dem Party, not government rules.. I have 3 personal examples AND there is the Web Site... no bids etc. The GOP WANTS THE REVENUE FROM THE BIDDERS AS DO THE DIMS. JMO

I read the article, and while I think some of what the author predicts will happen, I fully reject that Roberts predicted this and caused it by ruling the way he did…there was no Roberts trap….

They boiled us frogs too quickly. And the frogs are jumping out. Frogs won’t be going back into the pot, if ‘14 elections are the wave that is expected.

I'd recommend being very wary of Republicans — all the corruption and lawlessness we're seeing uncovered cannot have gone on w/o their complicitness.

My, how different is the real reality. Democrats are looking ahead in abject terror at the November midterms. And when those results come in, when Obama's lame-duckness grows acute...

Agree completely.

The real question is: Was Roberts so obtuse as to actually believe his tortured ruling? Or was he responding to Democrat blackmail of some sort?

These new cases will provide Roberts with an opportunity to a.) come to his senses or b.) demonstrate that he is owned, lock, stock and barrel.

I’ve attended a divorce court with a friend, and it was not a pretty picture at all.

Funniest thing happened though. I was wearing a short skirt and a red satin blouse and was asked if I was a nun. I kept praying the Rosary for my friend, but she lost.

I kick myself for not making a scene at the place (I was so boiling inside, I left early), and not pursuing a vigorous appeal later. We should have hired a lawyer and took him there with us. But the biggest disappointment was my group’s acquiescence and resignation. Still, my own excuse, however weak, is that I wasn’t the main principal in the case.
