Court throws out Brian Terry family’s case; Appeal possible

A federal court tonight has thrown out a case brought by the family of Brian Terry, the Border Patrol agent who was killed in a firefight on the Arizona-Mexico border in December 2010. Sharyl Attkisson reports that money already awarded to the family precludes this sort of case from proceeding.

So because the family received a death benefit as part of employment by the federal government by their son, the court is saying they cannot sue the government for other damages.
This is purely to keep discovery out of a court case. The family needs to appeal pronto.

That's apparently what the court is trying to say, but I can't see a financial judgement eliminating a criminal charge.
If I shoot you and kill you ... and I pay your family a billion dollars ... does that mean I don't go to trial and receive judgement for murder ?
If that's where we are in our judicial system ... we MUST ...
I just stopped myself from being banned and being disappeared by the FBI.

This must be an issue of sovereign immunity. Obviously the government did not allow itself to be sued in this matter, why would they, they are guilty as charged.

What about a wrongful death suite; as that the gov.’t knowingly sent both agents [if not more] out in areas knowing that they were in danger & did not properly equip them for such operations.

You are correct. We have been in the probate court system for almost 3 years now. I recently complained to our attorney that there is nothing just about our justice system. He agreed.
