Sarah Palin and her PAC slapped with federal lawsuit for using iconic 9/11 photo

Sarah Palin and her political action committee have been named in a copyright infringement lawsuit over the use of an iconic 9/11 photo.

The newspaper publisher North Jersey Media Group Inc. is suing the former Alaska governor for posting a copy of the image on Palin’s SarahPAC website and her personal Facebook page without permission.

The photo depicts three New York City firefighters hoisting an American flag among the rubble at the World Trade Center after the 2001 attacks.

So we just have to keep slamming this media group by saying they’re just trying to profit off 9/11 rather than making this iconic image available to all if only on 9/11.

The picture was taken by an employee of The Record, owned by North Jersey Media Group. It is private intellectual property and cannot be used without permission, most particularly by someone with whom the owners disagree politically. Exact same principle as a painting, book or software code.

This is not something conservatives should disagree with. It’s their property. If conservatives disagree with how they want it used., they should get together and buy the rights, not appropriate someone else’s property for personal use.

The web has made it extremely easy to swipe images, text, etc. That doesn’t make it right or legal.

It is entirely possible Sarah didn’t realize this was private property. When pointed out to her, she apparently took it down, which was the right thing to do.

I think it’s the likelihood of Palin being targeted more so than the legalities. One wonders how often the photo was used but not dragged into court.

If you had personally taken a photo and owned the legal rights to it, would you object more if Palin or Obama used it without your permission?

I think that after all the lawsuits she’s been put through, someone should’ve been a little more careful about checking on the licensing.

Getty sues EVERYONE. They have a team that goes online searching for anyone that uses their images without paying for them. Its a huge racket that probably makes them almost as much money as their sales of images do. They are hated by many they’ve sued. In fact there are many lawsuits that have been dropped after it was discovered that they actually didn’t own the rights to them. They basically send a scary email demanding several thousand dollars or they will threaten to sue. A lot of people pay up out of fear. I had a buddy of mine get obe of their letters and he found out a photographer in Australia actually owned the rights to the the image he used who wasnt even aware Getty was claiming the copyright and heturned around and sued them!...Payback can be a beotch...lol

Exactly right. Some here need to brush up on Copyright Law. I am a professional photographer and I have successfully sued several persons and corporations for using my registered copyrighted images without permissible use licensing. The law is very clear. If you click the shutter, you own the image.

The image depicted here was not used for editorial use or personal use. It was used commercially. Palin’s marketing people should know better. Just because it’s “on the internet” doesn’t mean you can infringe on the rights of the photographer or copyright owner.

Like I said last nite, the media will never let Palin become President.

They’ll glorify a two-bit hood from Chicago and continue to do so despite being the worst POTUS in our lifetimes.

They will ignore the numerous scandals of his administration, but they will put this “scandal” on the front page of just about every major newspaper by Saturday and the comments section of those newspapers will be filled with people calling her stupid and repeating the numerous myths and lies about her that were created by the media.

The irony is that they will parrot things she never said, then call her stupid for allegedly saying them.

Basically there are too many stupid, lazy, government dependent people in the US to ever vote for someone like Palin, who stands for what America used to be before the degenerates took control of Academia, Media and Politics.

Like I said last nite, things like God, Hard work, Traditional Family, etc...are no longer valued in the US and are actually frowned upon.

But Homosexuality, Bashing religion, Trashkardian TV, Miley Cyrus, Trayvon Idolization, etc...are glamorized by the media, which is comprised mostly of queers, fema-nazi’s, marxists and America-haters/Obama-lovers.

A majority of Americans have been brainwashed by the media into believing Palin belongs in a Mental institution.

When Palin gave her acceptance speech in 2008, I stated that the media would do a hit job on her unlike anything we’ve ever seen.

Sadly, I was right.

A woman who is pro-life, who succeeded without Government assistance, who isn’t a clip-haired, angry looking lesbian will never stand a chance.

The media will eviscerate her or anyone like her, and the sheeple will follow their lead.

They would promote Rachel Jenteal as an intellectually superior candidate over Sarah Palin.

This pic has been in the public domain for 12 years and reprinted millions of times.

I don’t see a copyright on it either.

They are going after Palin because of who she is, not that she used it as a tribute to those that gave their lives on 9-11

Obama could wipe his ass with it and the media would never utter a word about it.

I think you are onto something about sueing her out of existance since it was the only way to stop her albeit for a short time. Fighting petty lawsuits can be very time and resources consuming. I hope she can come back and stick it to the libs BIG TIME.
