Texas Deputy Suing Woman Who Called 911 (failed to mention perp on bath salts)

A Texas woman who's 911 call led to a police shooting is now facing a lawsuit from one of the responding officers.

Deputy Pullen is now suing the homeowner who called 911 for alleging that she did not adequately warn others of how dangerous the man was. Pullen's attorney says he suffered injuries because of the homeowner's negligence and failure to inform emergency workers of the man's potential for violence.

I know if the case was not dismissed and I was selected to be on the jury, I would hold out for no monetary award but would require the defendant to buy and present a copy of “Being a Deputy for Dummies” in a public forum.

This is crazy. New rules for calling 911?? Did the perp live with the 911 caller? Not that that should make a difference.

did the 911 police dispatcher bother asking her if the perp was dangerous or on drugs? Seems to me it’s the dispatcher’s job to gather the intelligence from the caller who is typically panicked and quite ill prepared to think clearly during an adrenalin charged situation.

I find it difficult to support a cause for liability on failure to inform on someone else’s behavior. If someone called and said “he has a gun” but did not say it was a machine gun, could they be found liable? How about a “stranger person in the neighborhood” and it turns out that person is armed. Does the failure to report the person being armed create liability?

Does not seem reasonable to me.
