Who cares if jurors have no idea what's going on? The wave of politically-correct "progress" must roll on. And discrimination against people who don't speak English simply won't be tolerated.
CBS Las Vegas reports:
The New Mexico Supreme Court is cautioning trial courts and lawyers that citizens who dont speak English have the right to serve on juries. Will this ruling permit Mexican nationals to serve on U.S. trial juries in New Mexico? Very likely. Consider that New Mexico has the highest percentage of Hispanics of any state, its 120,000 illegal aliens comprise a full 6% of the population; all of them can legally receive driver's licenses; and New Mexico does not verify citizenship for jury duty. The court issued the admonition in a ruling that upholds an Albuquerque mans convictions for murder and other crimes in the bludgeoning death of his girlfriend and a subsequent armed robbery and stabbing.
Michael Samoras appeal argued that his convictions should be reversed because a Bernalillo County judge excused a Spanish-speaking prospective juror who had trouble understanding English.
The Supreme Court says it agrees with that argument but also says Samoras defense needed to object during the trial but didnt.
The ruling issued Monday tells judges and lawyers that they must make reasonable efforts to protect the rights of non-English speaking citizens to serve on juries.
The inmates are running the asylum. Except they are wearing black robes instead of more appropriate white straightjackets.
If YOU stand us against illegal alien amnesty and demand the border be secured, and the rule of law upheld, then put your name where your heart is, and join the 170,000 who have signed the petition
No problem. In a few years all trials will be held in Spanish or New School Ebonics....
People unable to follow what going on is the basis of the DNC.
There’s a right to serve on a jury?
If a peremptory challenge prevents me from serving on a jury on which I want to serve, can I sue due to the violation of my right?
Speaking of my right, do I have a right to a trial by a jury of my peers and if a juror does not speak at least common English, is that juror one of my peers? Given that situation, and a guilty verdict, could I appeal based on deprivation of rights or something?
ah........ah....
well.....
this is utterly INSANE..as Surreal as a Bad B-Grade Science FIction flick from the 1950...yet actually DANGEROUS.
I can’t see this possibly being allowed to stand.
Looking at it from a simple logistical Point of Veiw its WAY over the edge. Trials lasting twice as long due to translation ISSUES??? Arent our courts backed up enough already??
current solution: dont Visit the place or do business with anyone in New Mexico!
I can see some pissed off judges when cases run much longer.
(1) The panel did not mention Spanish. ANY language.
(2) From Wikipedia...
The original state constitution of 1912 provided for a bilingual government with laws being published in both English and Spanish;[46] this requirement was renewed twice, in 1931 and 1943.[47] Nonetheless, the constitution does not declare any language as "official."[48] While Spanish was permitted in the legislature until 1935, all state officials are required to have a good knowledge of English. Therefore New Mexico cannot be considered a bilingual state as not all laws are published in both languages.
and if the translators are doing a bad job and helping get criminals off??
Sign the petition? What for?
Here in California, 7 million people voted “Yes” on Prop 8, 600,000 more than voted “No.” One man in a black robe overturned the will of 7 million.
In 1994, 5 million voted “Yes” on Prop 187 which would have established a state-run citizenship screening system and prohibit illegal aliens from using health care, public education, and other social services. Overturned by another black robe dictator.
Pardon me for being completely cynical, but what’s the point? We live in tyranny.
Isn’t there an English proficiency requirement for citizenship?
Racist cracka.
Part of naturalization is speaking English.
So foreigners, illegal aliens perhaps, are going to sit on juries. They’re not my peers.
Who is going to provide translation? Will it be accurate? Will nuances be lost?
This is utterly unacceptable.
Judge to the jury Foreperson: Have you reached a verdict?
Jure Foreperson: Si
Judge: And what is your verdict?
Jury Foreperson: Superman no here.
Is the defendant’s right to a fair trial now superseded by the (non-existent) “right” to serve on a jury? I keep looking for the light at the end of this rabbit-hole into which I seem to have fallen.
You could move to the new state of Jefferson...
And, thus, the idiocy and lunacy ruling America rolls marrily along!!
And, we wonder why America is sinking faster than the Lusitania!
If they don’t even speak my language, despite being citizens, they cannot be my peers. So they would likely be dismissed during jury selection.
Thanks montag813.
