Mayor Bloomberg's attempt to prohibit certain large sugary drinks from being sold by certain city purveyors was dealt a blow this morning when an appellate court upheld a previous decision by a judge named Milton Tingling, you may recall striking down the ban. Both Bloomberg and Health Commissioner Thomas Farley had said in May they were "confident" that Tingling's ruling would be overturned. The case can still be appealed to the Court of Appeals, the state's highest court. DaIn a unanimous decision, the court declared today that the ban "violated the state principle of separation of powers," Reuters reports, presumably concurring with Judge Tingling that the Board of Health overstepped its authority by enacting the anti-soda policy without approval from the City Council. And Bloomberg likely won't get the approval of the City Council anytime soon: Christine Quinn, both a mayoral candidate and the council's speaker, supports soda freedom.
This post initially reported that the Court of Appeals had upheld the prior ruling, but it in fact was the Appellate Division of the Supreme Court.
Great news comrades!
b.t.w. What did the nanny state consider "Enormous" and how did they make that determination?
So what is Tony Abedin-Weiner’s position on enormous sodas?
The smart entrepreneur will sell a 64 oz soda-cup and call it the Bloomberg Buster!
I propose that any sodas above 64 ounces should be referred to as a “Bloomberg”
If this has stood I would have started offering “Buy One 16 oz. Soda, Get 3 Free!” promotions.
Perfect lunch special to go with the “Tony Weiner Big Bratwurst”
Finally, our Constitution is good for something for the first time in the last 4 years!
Bloomers wants to outlaw Costco next for selling things in those great big packages.
I mean, who needs 100 rolls of toilet paper all at once?
I think I’ll use that next time I order a large drink. “I’ll have the bloomberg, please”.
I though Monica has the trademark on that name?
Bloomber is dumber than dumb. His support of an Islamic mosque at Ground Zero is yet another idea that lacks in reason and common sense.
