Besides being a way to get out of tipping, this ploy gives the cheapskate non-tipper self-serving justification for being a jerk. This will generate a lot of ill-will when hard working waiters and waitresses get stiffed on their tip based on a jury verdict they had nothing to do with or could affect in any way. Its stupid and petty - and cheap.
Chances are they are not tippers anyway.

When they descend en masse to my small coastal town for “Black Spring Break”, the restuarants are doing good if they don’t walk out in large groups without paying the bill.
