Can the defense mention this during closing args?

That`s why in the closing, Mark O has to say at some point, manslaughter or assault still gets him heavy prison time. I know he is not supposed to say it, but there is a way to slip it in sounding almost unintentional.

The prosecutor will stand up and object, The crooked judge will spank him and tell jury to disregard, but I think it`s worth getting it out there in some fashion

MoM indicated assault could result in equal or more time than Murder2.

That fact must be conveyed somehow to avoid them trying to split the baby with a compromise verdict.
