Madison — After a hastily called hearing, a federal judge Monday put a 10-day freeze on a new state law requiring doctors who perform abortions to have hospital admitting privileges.

In a 19-page opinion issued Monday evening, U.S. District Judge William M. Conley cited a "troubling lack of justification" for the law and said he would stay enforcement of the admissions provision until July 18, a day after a more deliberate courtroom hearing scheduled for next week.

"There will almost certainly be irreparable harm to those women who will be foreclosed from having an abortion in the next week either because of the undue burden of travel or the late stage of pregnancy, as well as facing increasing health risks caused by delay," the judge wrote. "Since the state has failed to date to demonstrate any benefit to maternal health of imposing this restriction, there is no meaningful counterweight recognized by the United States Supreme Court to justify the act's immediate enforcement."

Conley's ruling does not affect a separate provision of the new law requiring women to undergo an ultrasound before having an abortion.

Abortion clinics filed the lawsuit in federal court in Madison on Friday immediately after Gov. Scott Walker privately signed the law, which went into effect Monday. The measure is expected to cut the number of clinics offering abortions in Wisconsin from four to two, and cause one of the remaining clinics to sharply cut the number of abortions it provides, according to the operators of the clinics.

Without Conley's action, one clinic would have had to cancel 30 abortions or related appointments, with additional cancellations also needed at the other two clinics, attorneys for the plaintiffs said Monday.

It never ceases to amaze me how quickly libs can shop a judge who will immediately issue a restraining order under some ridiculously vague reason (”lack of justification”?).

Judges can now rule on justification for a law?

That is ridiculous

Is it permissible via our constitution

That is their only concern

If justification is grounds then damn.....all legislation is suspect

Obviously no justification for thinking that a doctor who does dangerous operations should have hospital admitting privileges. Just mean-spirited bigotry. Why, it's every bit as ridiculous as imagining that children need mothers and fathers. Those with such un-PC viewpoints should be aborted immediately.

The stated objective of the Commies/Union Goons& other leftists in WI when Walker won the election in 2010 was to make the state ungovernable.

EVERY major bill is going through the same crap, I have been surprised that CCW didn’t. They file in Dane Co. with a far left nut case judge and get a favorable ruling, then try to get the appeal in Dane Co. Then eventually the high court in WI strikes rules in our favor. This delays the laws our guys pass for 2 or more years since the Dane Co judges put on injunctions.

This is not too far off from what happened in DC in 2000; the objective of the left was to make the nation ungovernable. When 9/11 happened Bush still did not have his cabinet in place. This MAY have allowed 9/11 to have happened. We will never know.

These leftists are just plain evil. The care ONLY about their own power.

And yet again, the expressed will of the people through their legislature is blocked by an unelected, life tenured, clown in a gown who answers to no one.

My recollection of the U.S. History that I learned back in the Dark Ages, known to some as the early 60's, was that we had three co-equal branches of government, not one branch that, by virtue of life tenure in office and the so-called power of Judicial Review, a practice of somewhat questionable Constitutional authority, trumped the powers of both the Legislative and Executive Branches - not to mention the expressed will of "We The People!"

Do we need some "change?" Hell, yes!!!

My mom’s a doctor and she has hospital admitting priviledges...why is this a bad thing???

If she has to admit patients into a hospital she’s sees them there. The insurance companies pay her more for seeing patients in hospital than in her practice!

Gov. Walker and the legislature already defunded Planned Parenthood.

Tonya Reaves just south in Illinois, Chicago, died at a Planned Parenthood clinic last year.

As far as I’m concerned, those who support Planned Parenthood have some responsibility in deaths like this.

Other states have had to fight these legal battles as well, sometimes with some noteworthy victories, Planned Parenthood has already been thwarted in Wisconsin.

Governor Walker has acted bravely in his office on many subjects,

I read in these forums of his faux pas per his immigration comments but it seems he walked that back. That’s another topic. I consider the man close to a Saint.

Let me get this straight... A state legislature debates and adopts a bill. The governor signs the bill and then it needs approval from a Federal judge who applies a standard of “troubling lack of justification?” not a Federal question or a constitutional question. Just a “ lack of justification.” This is insane! Wisconsin patriots need to hit the streets... Apparently, Wisconsin is no longer a sovereign state. Just an administrative district of the FedGov.
