New York sheriffs voice opposition to strict gun law, seek to join lawsuit

ALBANY, N.Y. – County sheriffs have asked to join the federal lawsuit challenging New York's tough new gun restrictions, calling some provisions vague and impossible to enforce fairly.

The New York State Sheriffs' Association and five individual sheriffs are asking U.S. District Judge William Skretny to add their position to the record. They support gun rights advocates seeking to block enforcement of new bullet limits for magazines and the tighter definition of assault weapons.

The sheriffs agree with the New York affiliate of the National Rifle Association that the law, passed after the Newtown, Conn., school shooting, is unconstitutional because it will prevent citizens from keeping commonly used firearms for home defense.

"The Supreme Court has confirmed that the Second Amendment protects arms typically possessed by law-abiding citizens, and identified that the right of self-defense is 'core' protected conduct that is at its zenith in the home," the sheriffs' brief said. "At a minimum, laws that criminalize the most common rifle in America today - a rifle that is often selected precisely for its self-defense capabilities - impinge upon that core right. The same is true of laws banning standard-capacity magazines."...

The Albany County District Attorney’s Office prosecuted 4 cases involving assault weapons last year
none of which involved their use in the commission of a crime
and a recent FBI report showed that hammers and clubs were responsible for more deaths than rifles and shotguns ..

The SCDSPBA believes this is absurd, serves no public safety interest in the slightest,
and crosses the proverbial line from reasonable restrictions on gun ownership to outright harassment of law-abiding gun owners.

SO for .007 % , New York State Governor Cumo trampled the 2nd Amendment rights of New York State Citizens .
Saratoga County is but an example of the Statewide effect.
NY SAFE ACT was designed in back room agreements
NY SAFE ACT brought out at 11:00 PM before the State Senate.
With Roll-call and discussion(?) passed at 11:20 PM
Legislation was passed on emotion , not on logic .
Also , it was passed to give Cuomo name recognition prior to Obama’s proposal for gun control.

Overheard on a ‘hot mic’ was a discussion by political democrat party Senators
was that this was a prelude to total CONFISCATION !

I don't think the effort to repeal the atrocious NY SAFE Act is without merit. It puts those traitors in the NY Senate on notice at the least. They need to be primaried.

Only the inescapeable fact that we have an evil & criminal government could explain how for decades they have been able to add infringements to an Amendment which clearly states: “SHALL NOT BE INFRINGED”

If we as a society want restrictions then the only legal means, assuming anyone believes we still have a functioning Constitution, would be another Constitutional Amendment which would allow clearly defined restrictions.

Any judge ruling against ANY part of the Constitution MUST suffer the declared penalty for treason. NO EXCEPTIONS! If we as a society refuse to inflict this penalty to anyone in government who violates the Constitution and thus has committed treason, then WE are to blame for the country’s rapid swirl down the toilet.

My copy of the Constitution says nothing about restricting me to my “home”. Yes, I might be too picky, but I will not yield to even a hint of infringement.

If someone is going to use percemtages for one's argument, at least get the math right. Here's the correct calculation for the percentage:

5 divided by 769 times 100 = 0.650195058518 per cent

Rounded up, that is 0.7%, not 0.007%!

That is almost 1%, or one out of out of 100 homicides; very small, but not negligible.

That fraction ought not to suggest that the state law ought to be radically changed for all guns on the basis of the use of one scary-looking modern style sporting firearm type.

The New York State bicameral legislature consists of a congress of fools. Even though being correct on principle, the SCDSPBA is not much brighter, math-wise. (And for a shortening of their organization's name, they are in strong competition running against the old SPEBSQSA, who have finally given up on alphabetization as being cumbersome, and are now known simply as The Barbershop Harmony Society--even longer in actual use, but simpler to explain.)

A simple way to starve the gaping maw of government in NYS is to set a recurring yearly reminder on your computer to get your car inspected in time. Local governments are now dependent on pulling people over and charging ridiculously high surcharges on top of fines to garner revenue. If even half the people who are now being snagged were not in the future, these petty bureaucrats would being to feel some pain and have to look for another more obvious way to bleed the taxpayers.

I agree completely.

When our government has shown, without a doubt, a willingness to use just about everything except carpet bombing and the occasional nuke like their actions in WACO to bar-b-que its own citizens, the REASON and MEANING of the words “SHALL NOT BE INFRINGED” become crystal clear.

At minimum the citizens must have the ability to defend themselves against anything an out of control government is willing to use against them.

Those traitors need to be kicked out of the Republican party IMO. The left holds abortion sacred; the right needs to hold the 2A sacred. It is a civil right. Anyone going against it is a Traitor.
