HOUSTON -- The man accused of hitting and killing a Harris County sheriff’s deputy while driving drunk was in the country illegally, a judge said in court overnight.

Andres Munos-Munos, 23, was charged with intoxication manslaughter in the death of Sgt. Dwayne Polk.

According to the Houston Police Department, Munos-Munos allegedly ran a red light on Little York at N. Shepherd and hit Polk's personal truck shortly after 3 a.m. Sunday. HPD said there were no skid marks to indicate Munos-Munos even attempted to stop prior to the crash.

Whenever an illegal alien kills someone in a drunk driving accident or something similar, here’s what I recommend:
What can we do about it? Here’s my standard post.

RICO —Citizen Recourse

Private persons and entities may initiate civil suits to obtain injunctions and treble damages against enterprises that conspire to or actually violate federal alien smuggling, harboring, or document fraud statutes, under the Racketeer-Influenced and Corrupt Organizations (RICO). The pattern of racketeering activity is defined as commission of two or more of the listed crimes. A RICO enterprise can be any individual legal entity, or a group of individuals who are not a legal entity but are associated in fact, and can include nonprofit associations.

Here’s what I’ve been pushing: it’s time to file Racketeering, Influencing, and Corrupt Organizations (RICO) lawsuits.

RICO lawyers could turn it around in a few years and MAKE MONEY at the same time. I’m surprised they haven’t done it already.

In the absence of enforcement, we can get the word out in the meantime that there is money to be made in filing RICO lawsuits against employers who hire illegal aliens like this jerk.

Employers would have no trouble shutting down the border if they could get sued by someone under the RICO statutes for hiring these people in the first place. The next time an illegal alien kills someone in a drunk driving accident or somesuch thing, I’m going to point out that the victim’s family might be able to seek compensation from the employer under these statutes in the hopes that it would catch on. If this did catch on, would see such a swift backlash against illegal immigration that no employer would go near these people and they’ll all simply want to go back home.

I won’t ask for the freeper’s name. But as we both know freeper’s are a diverse group that agree on some issues and disagree on others. But the freeper who said “this stuff doesn’t happen and illegals don’t rape anyone”, is a DU sleeper.

wasn’t there a similar story from Ohio where the judge let the guy go, blaming the incident on cultural differences?

If you could find their employers. Many get paid cash working as day laborers. Many more are off the books. Then you have many using false ID’s.

Nice try, but sadly it will not work as a general remedy. Maybe, there might be a large employer who is ignoring the law and could be sued, but it will definately not dry up the money so easily.

And while you could bring a civil suit, you might actually get the feds stepping in and funding the legal defense like they have opposed AZ law enforcement on federal immigration laws.

If you could find their employers.
***I could find the employers of illegal aliens, given the resources available under the RICO act.

Many get paid cash working as day laborers.
***I have been approached for “cash working” under such conditions. It is not that difficult to trace such employers.

Many more are off the books. Then you have many using false ID’s.
***After such a civil roundup, the rest will simply want to leave the USA. And if there are significant amounts who continue to hire illegals, then the RICO act will generate treble damages for those who continue to pursue it.

Are you saying that civil suits would accomplish this even without the federal government starting to enforce the immigration laws?

If so, I still don’t buy your argument as being the solution.

Your idea is a good one, just not a panacea.

We need the federal government to enforce the law or, at the very least, stop opposing local and state law enforcement from doing their duty.
