They exempted THEMSELVES as “citizens at the time of the adoption of the Constitution” - what about those born between when the Constitution was adopted and when England no longer considered all Americans as English (after the war of 1812)?

Was anyone born between those times, even if born of two American parents on American soil - not an NBC because England considered them English?

Cruz would be a citizen "by statute", just like John McCain who required an act by congress to attempt legitimacy of his questionably constitutional White House run.

McCain's parents fell under the military service section. It was determined by Congress that McCain was born on "US soil", the military base in Panama, but they lied. There was no maternity ward on the base so his mother had to go the hospital outside the base to give birth.

Cruz's parents were in Canada working in the oil industry not in a military capacity. Cruz was born in Canada and the family came to America when he was 4. His mother is American but his Cuban father did not become a naturalized US citizen until 2005.

I voted for Cruz in his run for the Senate and I'd vote for him every day for any office other than POTUS. It's too bad his father didn't forsee this and become an American citizen before Ted was born but we must follow the Constitution.

Those born two two American citizens on American soil can ALSO be dual citizens at birth.

How so? The only scenario I can see that happening is if one of the parents is a dual citizen.

If dual citizenship at birth is a disqualification for being a natural born citizen - then Happerestt (sic) would be incorrect

Happerset never ruled on the other circumstances, it just stated that there were doubts, so how could it be incorrect?

Now, can Cruz be out there as a Trojan Horse on this issue, which is exactly what is happening.

It is fun watching them twist and turn and get their bloombers in a bunch trying to come up with some reason to somehow separate Cruz' ineligibility from hussein's. Their births couldn't be any more similar, tee hee.

England thought that Americans were English until 1815. Between the adoption of the Constitution in 1787 and the end of the war of 1812 - in 1815 - Presidents Fillmore, Pierce, Buchanan, Lincoln and Johnson were all born.

Were none of these U.S. Presidents qualified because England considered them English according to English law?

in this very important Constitutional matter.
They know the confusion is one of Constitutional interpretation
and their specific job is to interpret the Constitution.
Just because a Constitutional issue has political ramifications
doesn't get the courts off the hook.
Consequently, they have caused grave damage to this country
by their abdication of their sworn duty.

Justice Thomas has as much said so. It takes 4 Justices to accept a case on appeal. Apparently there is a grave disagreement on the court with at most, only 3 Judges at any one time agreeing to hear one of the many appeals that have reached the court.
There is also evidence that the SCOTUS staff itself has committed various forms of chicanery with cases submitted in order to sidetrack them.

We have lived through an anti-constitutional coup; a very successful one.

yes he’s not eligible just like the Transformational usurper-in-chief. Which is why the “Ministry of Truth” is afraid of Cruz. If a Kenyan daddy’s boy can Occupy casablanca, why not a Cuban daddy’s boy? The propagandisdtas have opened Pandora’s box and they realize it.

Contrary to popular opinion, U.S. military installations and embassies are not considered U.S. soil for the purposes of determining citizenship.

He got his citizenship by birth alone. He never had to be naturalized. The constititution mentions three statuses. Aliens (he is not) Citizen (can include immigrants), and the smaller subset of citizen “Natural Born”.

If you are a citizen, and didnt get naturalized, you are natural born.
Cruz qualifies easily.

Exactly right again. Although you've got to love Ted Cruz's effective, unashamed promotion of conservatism (we certainly could use a few dozen more politicians on the national scene like him), he is not a natural born Citizen, so he cannot ever become a legitimate president or vice president (yes, I know that didn't stop aka obama).

He could do the country a great service by holding a series of very public press conferences whereupon he discusses the very serious doubts about his ineligibility based upon both his foreign birth and his father's non-citizen status at that moment. He could educate the country as to the original intent of founders and remind the press and public that this issue has already been decided by the supreme court as affirming the definition requiring birth free from any foreign allegiances (born exclusively 100 percent American by both blood and dirt). He could bring up the simple, irrefutable fact that the founders intended that to assume the presidency, one must be more than a mere born citizen, but be in fact a natural born Citizen. He could then rhetorically ask, "Why would the founders have included the modifier 'natural' in the phrase if it added absolutely no additional meaning?"

Ted Cruz has been presented with a golden opportunity to bring this issue to the national spotlight. I hope he is man enough and patriotic enough to yet do so (yes, I know a spokesman in his camp already said some weasel words about this issue, but I want to hear it from his own mouth discussed in detail).

When a new citizen naturalizes, they swear an oath of exclusive allegiance to the USA officially breaking any other national ties as far as the USA is concerned. Thus, regardless of any claims to the contrary, the children of two naturalized citizens (or one typical native and one naturalized citizen) are recognized as non-dual, exclusive U.S. citizens under U.S. law.

The grey area comes when a U.S. native born child of a U.S. citizen and a resident alien is allowed to pass into their majority (usually at 18) without having to swear an oath of exclusive allegiance to the USA. This was never the intent of the founders in my opinion and dual citizenship for such children should not be allowed past the age of majority.

How is the father’s status relevant to citizenship status if the mother’s status is replied upon?
