Dallas Judge Halts Execution of Texas Woman; Uncertain If Prosecutors Will Appeal Reprieve

A Dallas judge has halted the scheduled Tuesday night execution of a Texas woman who would have been the first woman put to death in the U.S. in three years.

The order from state District Judge Larry Mitchell moves the execution of Kimberly McCarthy, 51, to April 3.

McCarthy faced lethal injection for the 1997 beating, stabbing and robbery of a 71-year-old neighbor in Lancaster, about 15 miles south of Dallas.

"(McCarthy) quite literally took the woman, put her left hand on a chopping block of the kitchen and then used a knife to sever her ring finger while she was still alive," said Greg Davis, the former Dallas County assistant district attorney who prosecuted McCarthy. "She took the ring from the finger that had been severed and continued the attack until she finally killed her."

Geez. A total savage. Why did the prosecution not seat a jury of 11 whites? They had to know it would be overturned.

That should have been "why did the prosecution seat 11 whites?"

Of course it shouldn't matter, but it always does.

It sounds as though Mrs. Mitchell’s little Larry couldn’t take the heat. I think that he’s in the wrong profession. He needs a job where there is more hugging involved.

D.A. has now said they will not appeal. This woman is a poster child for the death penalty. She actually murdered three different elderly woman all by some form of bludgeoning. She has only been tried for this murder but her DNA ties her to the other two

McCarthy is a former wife of Aaron Michaels, founder of the New Black Panther Party, and he testified on her behalf. They had separated before Booth's slaying.

She's killed 3 times. She's that special sort of animal who will kill again ~ a guard, a visitor, a fellow prisoner guilty of a white collar crime.

All they do by extending their lives is make sure these people kill some innocent party no one knows.

Please note: The headline at the link now reads:

I don't call that "halts." I am aware that since this is a NBC news source they may have changed the title, but the article clearly states there is a new execution date, 4/1. She'll still ride the lightning.

The execution of Kimberly McCarthy was postponed by a Texas judge on Tuesday, the day she was to die, to give her lawyers time to argue that racial discrimination played a role in choosing the jury that convicted her.

It was rescheduled for April 3 and, if carried out, McCarthy will be the first woman to be put to death in the United States in nearly three years.

Dallas County District Court Judge Larry Mitchell delayed the execution, which was scheduled to take place after 6 p.m. local time.

“Of the twelve jurors seated at trial, all were white, except one, and eligible non-white jurors were excluded from serving by the State,” said Maurie Levin, a University of Texas adjunct law professor who assisted in representing McCarthy.

No surprise. The DA thinks that being Black should be grounds for an appeal. He’s let out all the rapists he could find where there was any other DNA at the crime scene.
