She had to have been borderline suicidal before the hoax. Are we even sure the suicide was related to the hoax? There’s no way a prank call from a DJ sends a someone from “normal” to “suicidal” in two days.

you can’t blame the victim.

The DJ’s are 100% liable. There is forseeablity to some form of damages. If she dropped dead on the spot when she was told it was a prank it would be no different liablity.

The law is clear in england, canada, usa, and even austrailia.

It seems incredibly irresponsible of the news to imply, at least, that it was because of the radio incident. Even if that was a “last straw” we would have no idea, really.

Come to think of it, if there were societies for the defense of suicide, which there probably are, wouldn’t they be justified in countering with “Life is a temporary solution to the forever problem of nonexistence”?

That is, ignoring the matter of sin, again.

Yes, I can. She killed herself. Intentionally. I don’t see why I should blame anyone else for her intentional act.

Suicide should not be considered a forseeable consequence of a harmless practical joke. You are right that if she’d dropped dead on-the-spot it would be no different. Sudden death isn’t a forseeable consequence of a harmless phone prank either.

They didn’t kill her. She killed herself.

What if I went and offed myself because you and I disagreed on this here internet forum? I’ll put it in a note. You were the last straw. Maybe the only straw. Forseeable? Liable?

What nonsense.

Like that girl who killed herself because of internet bullying, which is even worse nonsense (she could have turned off the computer instead).

In both cases, they chose to kill themselves because they were too sensitive. If it wasn't the phone call or the "bullying" would have been something else that set them to it, sooner or later.

does not matter. The fact she was of weaker disposition is hard luck for the PERPETRATOR.

The law is crystal clear. You take your victim as you find them.

Some consequence, whater it may be, is 100% forseable.

that creates the liablity.

the fact the consequence resulted in a death, even if self inflicted, is STILL THE DJ/perps liability.

it is the law, period.

Probably abusive treatment by managers for involving the hospital in negative PR was the last straw.

What law are you referencing? I know of no law regarding suicide liability for practical jokers. Much less a “crystal clear” one.

They committed no crime, as far as I am aware, so it isn’t a death incident to a crime. Even if they did ... whether suicide is forseeable for such a minor stunt is extremely debatable, if not completely frivolous. She didn’t die because of their recklessness or negligence — they made a prank phone call, and she died by her own hand with intent.

This would be thrown out of any courtroom I’ve ever practiced in.

She is liable. And, she should be.

Instead of killing herself, she could have had the two radio shock jocks traced and have decided instead to take out a lawsuit or something of the likes.

At least here in America, shock jocks like that would have gotten in BIGTIME trouble because of the HIPA law federal and any state laws to the effect.

Same principle as in insurance or criminal law.

For example, say you lightly rear end somebody....

If they are extremely delicate, pregnant and/or driving a tiny lightweight car it is YOUR problem.

The argument “well they were vulnerable, they had other issues, it’s not my fault they had back surgery last week/ are in the midst of a difficult pregnancy after 3 miscarriages” (both actual cases I know of where a 5-10 mph rear ender resulted in $200K + damages... tough tacos should have been more careful, luck of the draw as the judge basically put it) would get you laughed out of court. even if the same accident would have just been laughed off by a healthy person in a larger vehicle.

Or if one just jokingly says “I have a gun” and a guard or clerk starts shooting, innocent bystander hit. one hundred percent your fault.

I hope the jerks never work again and spend the rest of their lives looking over their shoulder for some member of the SAS to settle the score. It would be as if someone tried to get a first lady’s medical records from the hospital (ANY first or former first lady), I would hope they would be the recipient of a serious ass whooping and in fear of much worse for the rest of their corporeal existence.

They were jerks, the whole world thinks they are jerks, they had no business doing what they did and I hope they are made an example of for all “shock jocks” to take heed of for decades.

And I really couldn’t give a rip about the royals (outside of respecting William for his service to his country when he could so easily get out of it).

People are savaging these DJs.

It was a great prank, it not their fault this obviously disturbed women took her own life, if she would over this she was probably going to eventually. Very sad.

That would be the nurse’s problem, not the shock jocks. The ones holding the information are bound by confidentiality, not the ones fishing for it.

As for a lawsuit, what would she sue them for? It’s her responsibility to do her job correctly. All they did was give her the slightest bit of a nudge. Also, apparently her job wasn’t even in peril. Did they so much as scold her? What would be the damages? Emotional suffering, or sonesuch nonsense?
