Another tradition has been squelched. He never "dropped" the possum.. it was carefully lowered in a nice warm box and then released to run back into the woods.

I couldn’t imagine what a possum drop could be and was having visions of the WKRP’s turkey fiasco.

He apparently has a license that allows him to kill a possum (take), but not to “keep” a live possum.

So, he could kill the possum, get it stuffed, and drop it, but he can’t keep it alive and let it go.

PETA won’t allow the latter, but can’t stop the former.

Probably according to Hoyle this falls into some banned category activity with wildlife, and there would have to be some explicit provision for judicial exceptions like this one that got smacked. You can probably legally shoot the possum, but you cannot ceremonially lower it in a box.

So revise the silly law to allow safely lowering opossums in boxes and be done.

I would prefer an attorney drop.

Way more plentiful then possums too.

There may be an over abundance of them in most cities.

Obviously the judge does not understand animals very well.

I think the way around this is to get several hundred raccoons, and take them to the judge’s house in the wee hours of the morning, along with several hundred pounds of dry cat food on which they can feast.

Well they may have to take the approach that Yellville, Arkansas was forced to employe after the gov’t decided to shut down their official “Turkey Drop” during the annaul Trukey Trot festival.

http://www.roadsideamerica.com/story/16921

snip

Turkey Trot has been celebrated on the second Friday and Saturday of October every year since 1946. It was conceived as a way to call attention to the region’s abundant wild turkeys. A highlight of the festival was the “Turkey Toss,” in which live wild turkeys were tossed off of the roof of the County Courthouse. In the 1960s this was replaced by the Turkey Drop.

The thinking behind the toss/drop was that most of the turkeys would escape into the wild and thereby increase the local population. The problem is that wild turkeys can’t fly very well. Some of the birds would splat on the pavement. Some that landed safely ended up being chased around town.

The splattering and the chasing drew unwelcome national media attention in the 1970s and 1980s, and animal rights groups threatened legal action. Since 1990, Yellville has officially divorced itself of the Turkey Drop — it isn’t mentioned in any Turkey Trot literature — and yet it still happens every year. The town’s position is that mysterious planes just show up over the festival every October and drop turkeys (although the drop point has been moved to the south edge of town so that the pilots don’t violate FAA altitude regulations). Four or five drops take place each day, with one to three turkeys per trip.

end snip

This is their tradition!!!!! If native american’s can go out and stick harpoons in an endangered specie (whale) and wait for it to bleed to death because it is therir traditional hunt, well, wo is this. The NC natives have been doing this legally for 19 years and that makes it a tradition!!!!

...a judge ruled Tuesday that a state agency didn't have the authority to issue a permit for the event.

OK, Judge, show me the law regarding possum drops and the need or lack of need for permits.

*No possums were harmed in the writing of this response.
