Among the objections to ObamaCare, one that has not gotten as much attention as it should is the president's power to waive the law for any company, union or other enterprise he chooses.
The 14th Amendment to the Constitution provides for "equal protection of the laws" for all Americans. To have a law that can cost an organization millions of dollars a year either apply or not apply, depending on the whim or political interest of the President of the United States, is to make a mockery of the rule of law.
How secure is any freedom when there is this kind of arbitrary power in the hands of one man?
What does your right of freedom of speech mean if saying something that irritates the Obama administration means that you or your business has to pay huge amounts of money and get hit with all sorts of red tape under ObamaCare that your competitor is exempted from, because your competitor either kept quiet or praised the Obama administration or donated to its reelection campaign?
Arbitrary ObamaCare waivers are bad enough by themselves. They are truly ominous as part of a more general practice of this administration to create arbitrary powers that permit them to walk roughshod over the basic rights of the American people.
The checks and balances of the Constitution have been evaded time and time again by the Obama administration, undermining the fundamental right of the people to determine the laws that govern them, through their elected representatives.
You do not have a self-governing people when huge laws are passed too fast for the public to even know what is in them.

I hear you...I still can't get over what that witch of a so-called Speaker said about passing obamacare to find out what's in it even though I know there were many others involved. In my view that was a recall or impeachable offense.
It would also seem that affirmative action is on its face a violation of the 14th Amendment, just as institutionalized discrimination was before the Civil Rights movement matured (and later metastasized).

I think that’s a possibility or maybe the “work-around” he did disabled it.
I just checked it again and this still comes up, “The website declined to show this webpage.”
I bet you’re right, I bet it’s the work-around.

Unfortunately, because the kenyan has assumed these powers and has not been challenged by the Congress the President now has these powers which means that Romney, if elected, will have them also. Romney may forgo using those powers but he will have them and so will the president who follows him. The presidency of the United States has effectively had the power of fiat conferred upon it by the Congress. Those unconstitutional powers given by Congress to the President must be wrested back from the Presidency by the Congress and even then future governments will be more or less dictatorial depending on the relative strength of the President and his party. The President no longer has Constitutional restraints on his power. If his party controls Congress then he can and will exercise his fiat.
I just tried again and still nothing
Those who collect welfare / classify as poor and are eligible for subsidized state insurance but choose not to get the state insurance thus get out of the fine (due to poverty) and the insurance (by refusing the state option).
Muslims, Amish and Christian sects that don’t have insurance don’t have to use state mandated insurance. Unequal protection under the law.
Illegal aliens gain extra rights. They still get care for free in ERs, and they don’t have to have state insurance because they are not citizens and don’t have to pay the fine for not having it. Still subsidized by citizens, and exempt from the penalties.
