Bronx judge doesnt buy his claim of diplomatic immunity
A New York hotel maid's sexual assault lawsuit against French bigwig Dominique Strauss-Kahn can go forward, a Bronx judge ruled Tuesday.
State Supreme Court Justice Douglas McKeon decided that the former International Monetary Fund leader is not entitled to diplomatic immunity.
He derided Strauss-Kahn's claim of international protection as the legal equivalent of a "Hail Mary" football pass.
McKeon noted that the disgraced politician didn't cite diplomatic immunity last year when faced with criminal charges for the May 2011 encounter and pointed out that Strauss-Kahn resigned from the IMF long before he was sued.
"If Mr. Strauss-Kahn was entitled to absolute immunity, as he contends, there was ample opportunity before now to assert it," the judge wrote in a 12-page decision.
The maid, Nafissatou Diallo, 33, says Strauss-Kahn, 63, tried to rape her. But Manhattan District Attorney Cyrus Vance declined to prosecute the one-time French presidential candidate due to doubts about her trustworthiness.
In August, Diallo sued Strauss-Kahn in the Bronx, her home borough.

The evidence is she’s tired of working as a maid, and thinks this is a way out.
I don’t believe he did anything. I mean come on, he’s French! You just know the second he saw a strange woman in his room, he immediately fell to his knees, threw his hands up, and surrendered.
He only wished she was tired and took THAT DAY off or he was too tired to persue his lusty appetite.
DSK took part in an orgy he organized in DC the night before. His previous history is admissable.
But it’s only money for his biliionaire wife to pay, not jail time.

That’s mostly true - but they are only that sympathetic to certain plaintiffs, ones sharing the characteristics of this plaintiff. When the defendant shares those characteristics, they are sympathetic to the defendant.
Sorry, but you’re wrong. This doesn’t have anything to do with race.
If you are a plaintiff attorney in a civil case, you want to try your case in the Bronx or Brooklyn. If you are a defense attorney, you don’t.
FYI, the racial and social composition of Brooklyn and the Bronx has changed greatly in the last 10 years. For upper level income groups, Brooklyn has become more desirable and more expensive than some if the priciest areas of Manhattan. Houses in the 3-12 million dollar range and large family size apartments 1500-3000 sq ft in the 1-4 million dollar range. Apartments and houses often sell for more than the asking price! The Bronx is attracting more middle class working people with families.
There is no choice involved. Even though the attack took place in Manhattan, the jurisdiction for the civil case is the Bronx because the plaintiff resides in the Bronx.

Wow! Miss M. I had forgotten about Tom Wolfe’s great novel. That is a must read for everyone who wants to learn more about the decadence of the elite, and, as an added attraction, about the criminal justice system in NYC.
I could have sworn that Tom Wolfe had hidden under a desk in the DA’s office. That perfect was his capturing of the mentality and language.
This is still a great book, and well worth reading.
And remember: all the Bronx DAs in that book were desperate to have a white criminal. They were tired of marching black people through the justice system. I doubt things have changed much. DSK may be the perfect honky for an all-black jury!
We’re going to have to remain in disagreement. From what I’ve seen of New York, living in the Bronx and Brooklyn at times, it does.
