Palm Springs Nudist Resort Defends 'No Children' Policy

The co-owner of a Palm Springs nudist resort today defended the facility's policy banning children, saying it is not discriminatory -- despite claims to the contrary by an anonymous group of detractors.

Desert Sun Resort owners John and Elizabeth Young, who live in Orange County, filed a lawsuit March 16 in Orange County Superior Court against 500 unnamed defendants, asking a judge to rule that the clothing-optional resort's policy against children does not violate state law.

According to Elizabeth Young, the lawsuit was filed in response to a letter she received Feb. 17 from Palm Springs attorney David Baron. The letter, written on behalf of "certain individuals," threatened legal action against the resort "for maintaining and enforcing a No Children Allowed Policy and a Couples-Only Day Pass Policy," according to the Youngs' lawsuit.

"They threatened they had clients who wanted to sue us," Elizabeth Young told City News Service.

Baron could not be immediately reached for comment.

Young said her attorneys asked Baron to identify the "certain individuals" who were threatening legal action, but the request went unanswered. With the letter alleging that the resort was opening itself to "ongoing and mounting statutory damages," the Youngs opted to go to court to have a judge review the no-children policy.

California's Unruh Civil Rights Act prohibits discrimination by businesses based on age, ancestry, color, disability, national origin, race, religion, sex and sexual orientation.

Assuming you don’t want your nudist resort to become a pedophile haven, banning kids makes complete sense.

At the very least, it makes sense from a limitation of liability perspective ... you know who’ll get sued the first time a kid gets molested by some nudist creep.

It is, technically, discrimination. Discrimination is not necessarily illegal.

Kids do not need to exposed to nude adults.
They don’t need to be exposed to adults either.

Why can’t people elkave well enough alone. They want to run around naked, -—fine.
Leave the kids out of it.

I remember in dayona and sturgis when only adults went to the Motorcycle rallies, things got a little lewd, but it was all i fun and hurt no one. Then the yuppies and wannabee bikers started showing up and draggin their kids along and everything became more sterile. Ruined the fun IMO.

It depends on what kind of couples they are talking about. Many resorts in the Palm Springs area cater to gays.

Same thing during Fantasy Fest in Key West. Things got a bit wild, but everyone was an adult. Now they bus people WITH KIDS down from Miami. Kids should not be exposed to that behavior — it is not appropriate.

I’ve seen documentaries on nudist colonies and from what I saw these are NOT the people you want to see naked.

Coincidentally, I was just reading up on our local nudist resort here in my state. (Calm down, I do a lot of writing on our quirky history and our resort is the oldest in the country, celebrating its 75th year this year.)

Anyway, I was a bit floored to read their policy on children which was basically, “we’re okay with them if you do this and that properly.”

Sidenote, after looking at their website and pictures of the people there, my travel writing sidekick jotted down a question to ask: “When they say ‘oldest resort,’ are they talking about the resort itself or the age of the patrons?”

As a naturist (what nudists call themselves), I can relate to the no children policy at Desert Sun. However, where I live (just north of Tampa, FL), the county is known for more nudist resorts most states (13 plus 2 on the drawing board - along with a water park resort). Matter of fact, you'll see the school buses stopping in front of the gate of the largest clothes optional resort in the world and others, too.

That said, I do argee with the no children policy. Some resorts are not for kids. Desert Sun is one that I wouldn't classify as a nudist resort it is classified as a swingers resort. If you want more info on naturism... go to...

These places should be strictly adults only but it reminds me of something I saw on the bulletin board when I was in Army flight school a million or so years ago:

“Notice to airmen! Absolutely no flying permitted over nudist colony exactly 8 miles SSW from main airfield on a true course of 225 degrees!”
