For the record: Babeu Q & A on Fast and Furious

Q: When you says that those officials who carried out Fast & Furious should be considered accomplices or accessories to murder, are you serious, or is that a rhetorical point, that they could be charged? If serious, who in the ATF/DOJ chain of command should be investigated as possible accomplices or accessories to murder and other crimes? The line agents? Their supervisors? The U.S. Attorney's Office or Justice Department officials involved?

A: The American people deserve a thorough, impartial, and independent review of what happened here. Nothing short of that will ever be acceptable. The Justice Department has a serious conflict of interest in policing itself. So no more scapegoats--let's find out just how this happened, exactly who is responsible, and hold them accountable.

This is why the Sheriffs of Arizona both Republicans and Democrats are demanding a Special Counsel to investigate Attorney General Eric Holder and the Department of Justice for their roles in Operation Fast and Furious.

The Sheriffs are demanding the truth from U.S. Attorney General Eric Holder and believe that those responsible should be held criminally accountable for allowing 2,000 guns including assault weapons and 50 caliber rifles to be purchased on U.S. Soil and then turned over to the drug cartels of Mexico. As a result of their reckless facilitation and distribution of these weapons, our deputies and American citizens may now face the barrel of a gun that was placed in the hands of criminals by the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) and U.S. Attorney General Eric Holder. Citizens of the United States and Mexico have already been murdered by cartel members who now posses these weapons. There is no doubt more bloodshed will occur on both sides of the border, since over 1,500 weapons still remain unaccounted for.

Every last person involved, regardless of who they are. They All belong in prison in MEXICO for whatever life they have left. By the way nothing at all prevents the DA in the affected counties from FILING CHARGES except politics of course. File Murder Charges against all of them, have the Governor sign the warrant and demand extradition to answer the charges, FORCE Obama to issue Pardons it will end his career immediately.

And correct me if I’m wrong, but this total of firearms is JUST from one of the six or more gunrunning ops, right? How many more guns are out there, either south of the border or in Chicago or elsehwere?

The POTUS can only pardon FEDERAL crimes. If the state(s) want to file charges for murder, conspiracy, etc., they could file those charges and BHO could not pardon them, because they are state charges - not federal ones.

Yep. One op. The others we know about, but no estimates of how many weapons. But there are ops we DON’T know about that are still going. Where are they, why are they, and who are they?

That is called an Ace in the Hole and should never be revealed in the opening play or first round of betting.

There are countless situations in which various government personnel are well-known to have committed a variety of crimes for which they are never prosecuted, often because they pretend the actions in questions are not crimes. For example, recently some cops broke into a house which was clearly marked with an address different from the one which appeared on the warrant. The cops have not indicated any basis for believing that the clearly-marked numbers on the house had been tampered with. Could a reasonable person believe that a warrant for 2415 XYZ Street would authorize him to break into 2411 XYZ Street and accost the occupants therein?

If the Constitution is the Supreme Law of the Land, then by definition it must be superior to any rule which would give any government agents any authority to act contrary to it. A cop who forcibly enters 2411 XYZ Street without being able to demonstrate a reasonable basis for believing such entry to be legitimate is, like anyone else who forces entry, a burglar. If such entry is for the purpose of accosting the occupants of a dwelling, such a cop is also a robber.

It may be nice to think that prosecutors could go after government personnel who commit crimes, but even in what should be slam-dunk cases, it seems they very seldom do so.

The power of the Pardon doesn’t even come into play here. The principle is “Sovereign Immunity” and was used to free the murderer of Vicki Weaver, Lon Horiuchi, after the State of Idaho filed charges against him.

To this day Horiuchi has not paid for his crime. Hopefully someday he will, and I do mean in this world.

The question is why did Obama let the Sinaloa drug cartel get such a large stash of weapons? The only explanations I can think of are that they were able to blackmail him, or that he expects something from them by way of quid pro quo. In the latter case it probably would be connected to his effort to win re-election.

I think this goes to the top--no way Holder approved this and Obama was kept completely in the dark.
