Judge: Striking Wash. teachers could be replaced

TACOMA, Wash. (AP) -- A judge said Monday he's considering giving Washington state's third-largest school district the option of replacing teachers on the picket line as a strike continued despite the judge's order to return to work.

The unexpected comment from Pierce County Superior Court Judge Bryan Chushcoff came as Tacoma school district classes were canceled Monday and Tuesday due to the strike, the News Tribune reported (http://bit.ly/njc9RV ).

"That came as quite a surprise," district spokesman Dan Voelpel said. "We didn't ask about that in court. He began speaking out loud about actions to impose next week."

It would be up to the district to decide whether it wanted to hire temporary replacements, permanent replacements or come up with another plan altogether, Chushcoff said at a hearing Monday.

"I'm seriously considering doing that," the judge said. "Those are all possibilities."

If only there were enough Judges who aren’t Liberal Activists, nationwide, so that the Teachers’ Unions could effectively be neutered from their money-laundering-for-the-DNC/extortion schemes.

Admittedly, I didn't click the link but how can a judge impose anything if no one has brought it up? I don't like liberal judicial activism and I wouldn't like conservative judicial activism either.

Reread and see that he is giving them "the option", it's still judicial activism, if nobody asked him to.

One might think that a judge confronted by citizens willfully disobeying his orders might hold them in contempt of court, and send the police to arrest them or fine them to compel obedience. Giving them a pass and passing the buck to the school district does not impress me.

For decades the unions did pretty much what they wanted and ran the system into the ground out of greed, pure and simple.
What's there to think about?

They have gotten so used to "running things" through threats and intimidation that they feel entitled to replace elected legislatures, boards and councils.

Lets disabuse them of that delusion, the sooner the better.
That should send a clear and permanent message to the new batch of teachers. The taxpayers are the employers and the elected administrators will never again be allowed to make stupid contracts and then retire.

Responsibility will follow them in the future. I'm sure of it.

Whos is going to ask?
The district Boards full of elected ignoramuses are what transferred the ultimate power to the unions.

Boards create disasters and simply disappear. Someone else always "did it."

A BTT. The WEA is one of the most arrogant, dictatorial, corrupt unions I’ve ever had the misfortune to come across. Until the Evergreen Freedom Foundation came along they were virtually unopposed.

For all practical purposes a judge has absolute power in his court.

When a judge issues a legal court order and it is disobeyed or flouted, the judge has huge powers to coerce compliance.

After issuing the back to work order, the judge could jail all teachers that refused to work indefinitely, until they agreed to comply with his order, AND he can jail them for a specific period for failure to comply originally. Allowing replacement hires is a very minor punishment.

It's not wise to piss off a judge.

This judge is a corrupt liberal. He’s just hoping that the teachers will go back to work. No way will the state judiciary allow the teachers to be permanently replaced.

Having spent a couple days in jail once for contempt related to a discovery issue in a civil proceeding, I agree with everything you say.

That said, it begs the question of why isn’t the judge doing exactly that?

Likely answer: All counties all over the US are broke and locking up 1,100 people would be expensive.

He can impose it as a sanction due to the unions’ contempt of court. He was asked for and issued a return-to-work order, the union is ignoring it, he can sanction them.

The judge can’t order them to be fired. He can, however, break the union contract and allow the school district to fire them.

Likely you are correct, it costs money to jail those in contempt. Job loss also motivates without costing the jail budget, thus the threat to replace strikers.
