A Swiss dad celebrating the birth of his son with a trip to an Austrian casino won 43 million Euros - but then was told the cash would not be paid because it had been a "software error".
Behar Merlaku, 38, won the jackpot in the Bregenz Casino operated by Casinos Austria in March but after he was told there had been a mistake he kept trying to get the prize money for four months and is now going to take the case to court.
He told Austrian newspaper Heute: "When I won I was ecstatic and of course I relied upon it being a real jackpot which it was. I saw it on the screen. But then the disappointment came when two casino workers came to me and said there was a software error. They took me for a fool which I am not. I've played in many casinos and I know the way the cookie crumbles. It doesn't concern me if they have a software problem.
"I also received a letter saying that a casino worker had manipulated the jackpot by mistake. That's not my problem either, win is win.
"I will fight for this until my death. It is outrageous what they have done to me and my family. I want to spread what happened to me all over Europe. I don't accept it.

This was at the Sandia Casino on the Sandia Indian Reservation near Albuquerque about 4 years ago. IIRC, even the state couldn't help him, due to the sovereignty of the reservation, so his only recourse was the tribal council. Yeah, they're going to help. Ha!.

Who approved the ‘errored’ software for deployment?
Did the man gamble his money? Was his money accepted?
Seems like he gambled that the casino - who sets ALL the rules, approved the game for deployment, and took his money - to honor what they offered.
I’d like the courts to set a reward of $120 Million (Penalty) plus his winnings. You wouldn’t have to do that too many times, before the casion’s got the hint.

If anyone ever visits this casino again, they are a sucker to the nth degree!
This guy will win any lawsuit he brings against this casino. Any jury of his peers will rule in his favor. Whatever software error that happened to cause his win is not his fault. He won fair and square. If the casino is saying he did not win because of a software error, then how many people missed out on winning a jackpot because of a software error? They need to pay up!

Maybe when gamblers lose (by mistake), they should have a right to get their money back from the casino, too.

Yeah, just about all these machine have a maxium payout clearly posted on them. If the payout is over the max you get the max not what the machine says. Period, end of story.

I've never been to the casino, so I can't say for certain. The story seemed to state that fact, but didn't include anything other than the casino's word on it.
Granted, this was less likely to be a win than the original story above, but still, with computers you have a problem. Yeah, buddy, that, uh, jack-pot ain't gettin' paid, cuz you had, see, a computer glitch.
