The Obama administration is taking the unusual step of asking the U.S. Supreme Court to stop Texas from executing a Mexican citizen who was convicted and sentenced to die for the rape and murder of a 16-year-old girl.
The administration is asking the court to delay the July 7 execution of Humberto Leal, 38, for as long as six months to give Congress time to consider legislation that would directly affect Leal's case.

There's a way to operate: have congress pass a federal law to get an illegal alien violent criminal (undocumented criminal??) off the hook. I am guessing they pass a federal law that requires the federal government take custody of the illegal violent criminals to protect him from the states, not to protect us from them.
I heard Mexico might stop sending their 'undocumented tourists' to the US for visits if this case isnt stopped.

Bush attempted to intervene in a similar case some years ago, and was given a 7-2 smackdown by the Supreme Court, which said in effect that the consular requirements of the Vienna Treaty could not be enforced against the States without specific legislation. That legislation never happened; Leahy is trying to make it happen now.
The SCOTUS position on this is not an old one. The Supremacy of the Constitution over Treaties has been reinforced over and over again by the Supremes. The most recent binding precedent is from 2006, I believe, but I'm not interested enough to check it. The "2006" case again reinforced Whitney v. Robertson, among others.
Bush should have simply ignored the decision of the International Court in the first place. Why he decided to open this can of worms with presidential meddling, prompting the SCOTUS rebuke, has always been somewhat of a mystery. Probably a sop to V. Fox, and the State Dept.
It has been. This is the murderer's appeal to SCOTUS, and the administration asked to file an amicus brief on his side. Strange, normally the government files such briefs on the side of "the people" in cases, not on the side of the convicted murderer. What we have here is literally the people of Texas vs. the US federal government.

Federal agencies require us to have permits before we can chop down trees or modify our properties.
Little kids can no longer operate lemonade stands.
The sale of incandescent light bulbs is illegal.
The federal government takes no steps to protect our borders, and sues states that attempt to protect their own borders from foreign invaders.
The fastest growing economic sector is government employment, and the only boom town in the country is Washington DC.
I must say that the day when we no longer recognize America has come and gone. I truly do not recognize the nation that I grew up in.
The problem here is the liberals are adding to the Vienna Convention in relation to consular relations. Sure, it says that consuls have a function of helping their nationals in legal trouble. It doesn’t say the consul has to do it, or that anyone has to be notified. It only says they have to be notified if a person with official diplomatic credentials is arrested.

Better idea: require local government to inform Immigration and Naturalization Service when they have illegals in their custody or lose federal funding.
This POS has already been on death row longer than his victim was alive. It's time he wasn't.
I am sure he exhausted the appeal process too. Given Obama's judgement on this I wouldnt want him anywhere near an immigration reform bill.

Good point about medelllin. At the time everyone said mexico and others would be harsh on US citizens arrested in their country of we executed that POS Medellin.

Bush actually took a lot of heat for letting karla Faye get the needle. well sure she was a multiple ax murderer but she find religion in prison and CNN and 60 mins did a sob story on how she turned her life around.
